But a PCN civil not criminal.

Even where it hasn't been decriminalised? It looks like Gosport is one of the few areas it hasn't.

TBH, I'm not sure the OP knows what he's been issued. I've already asked who issued the ticket.

    So again OP,

Who has issued the ticket and is it a Penalty Charge Notice, Parking Charge Notice? What is the exact wording on the ticket, specifically the relevant Act that covers it?

Oh, and for the avoidance of any doubt, have you or have you not been through the formal Appeals process?

Gosport Councils website deals with payment for PCN and FPN, so some clarification is needed.

The acts and sections aren't usually on the ticket.

This is what they said when I said I wanted to formally appeal the pcn
" I note your request to make a formal challenge/appeal to an independent tribunal; however this is not the correct procedure. Gosport Borough Council operates its off-street car parks under a parking order made under the Road Traffic Regulation Act 1984. This means it is a ‘criminalised’ system, rather than a system that operates under the Traffic Management Act 2004 (known as a ‘decriminalised’ system). Breaching a parking order is a criminal offence by virtue of section 35A of the Road Traffic Regulation Act 1984. "

So do you have a FPN?

The ticket says "parking charge notice" and is issued by Gosport Council. I filled in the appeal form on their website - what I assumed was the informal appeal - when they rejected my appeal I was expecting be be able to make a formal appeal ie the process described on this site. That is when they told me it was a criminalised system and the next step is defending myself in magistrates Court.

I'd jump onto pepipoo.com for further advice. The power to issue PCN is civil and their website deals with PCN and FPN's.

Have you been given the correct ticket?

Filling out that form was part of the formal appeals process. They have rejected your appeal and will seek full payment. Up to you what to do next, either pay up or wait until you are issued with summons to court.

As already mentioned numerous times now, you'd better off posting on pepipoo.

The wording on the ticket says "parking charge notice" then it uses the acronym PCN e.g. "PCN number".

I don't have the ticket with me as I'm abroad so can't confirm what it says on the back - I have a photo of the front.
