Thanks for all the responses. The council have told me that:
The height of the vehicles does not include any attachments i.e. kayaks as they are not part of the main body of the vehicle. The signage clearly denotes this"
I've asked them for the wording of the sign that denotes this as I don't remember seeing it. They were quick to point out the sign that said "vehicles over 2.2m only", hope they're quick to get back to me with the other sign wording.0 -

The council people you've talked to so far appear to be trying to win awards for bureaucratic stupidity.
If you'd attempted to enter the car park, you would have risked hitting and damaging their height limit barrier, which no doubt they would have been pursuing you for.
If you'd presented yourself for travel on a ferry or the Channel Tunnel, they would have taken the vehicle height as including the roof rack load, put you in a loading queue accordingly, and not sent you under a low roof on the vessel or train.
How to solve it? I don't know. Some of the world's magistrates might be swayed by the council's case.0 -
Will the CPS be getting involved since it is criminalised? You might persuade them that it is not in the public interest which is part of the test for criminal prosecution.0

No, CPS will not be involved in a PCN it will go through Gosport Councils appeal procedure.0 -

Maybe you should post a link to your law.

The Con and Use Regs quoted on your paper. But still neither actually define height as you claim the law does.0 -
