All,
New member here, so please be gentle!
A few weeks back, I ordered four thermostatic showers from Groupon at a cost of £252.00
Two of the showers were delivered, but the remaining two weren't. I contacted Groupon customer services, who asked me to wait a further 5 working days to receive the remaining two items, which I did, but they still did not appear.
I contacted Groupon again last week politely asking them to either provide the remaining two showers, or issue me a partial refund for these.
Groupon have now come back to me with the following message:-
Hi Stuart,
Thanks for being patience and your response.
Given the circumstances that led to your request, I am happy to process a partial refund (£126) in Groupon credits. Groupon credits are simple to use, and are valid for a whole year for you to use towards almost any purchase on Groupon.
If you’d like me to go ahead and apply the credit, just let me know by replying to this email. The credit will be immediately available and last for a full 12 months.
If you have any further queries, please let me know.
Regards,
Sagar Bhadani

However, I do not want my money refunded as Groupon credits, I want it back as a full refund to my card!
Any suggestions as how to go back to them (I only received this message this morning)?
Cheers,
Stuart

Blackbeard,
Thanks for responding - it's not what Trading Standards told me earlier, though they didn't sound too confident either, but we'll see what transpires!
Additionally, this is a personal purchase for a house refurbishment we're doing, so not a business transaction at all.0 -

Simple. there terms and conditions prohibit business use, the purchase of 4 thermostatic showers I would say is not a normal B2C transaction!
This isn't the case though.
The OP purcahsed four Groupon vouchers which were supposed to be valid to exchange for a thermostatic shower. It turns out that two of the vouchers were not valid in this way. The vouchers were therefore faulty and the OP is due a full refund of their original payment, not simply credit.1 -
Right, all sorted.
Sent this yesterday based on what Trading Standards helpline told me to say, and received the response below, along with a refund to my card today! Hope it helps others....
Dear Sagar or colleague,
Thank you for coming back to me, and for your kind offer of a refund of £126 in Groupon credits for my undelivered goods.
However, a partial refund in Groupon credits is unacceptable to me in this instance, as you have breached the distance contract between us by not completely fulfilling the order to me. I therefore demand that you please provide my partial refund of £126 back to me in cash, refunded to the payment method used for the transaction (VISA debit card)
Please note I have taken advice from trading standards on this issue, who advise me I am due a cash refund within 14 days due to your breach of contract.
I look forward to hearing confirmation back from you on this matter.
Kind regards,
Stuart

Glad it worked out in the end.
However if anyone was to use your approach, I would be a little less forceful to start with. Request instead of demand.
Also check what you write. You wouldn't have spoken to Trading Standards as they don't talk to the public. Did you mean the Citizens Advice? Companies can tell if you're trying to call their bluff and could play hardball.1 -
Understood.
The helpline number I rang was the one given on the TS website, so call them what you will! :0)0 -
Hello, I just wanted to post my experience and say a MASSIVE THANK YOU to the OP on how to sort this. I bought an Invisalign voucher for £749, and had the consultation. It would've required an extra payment of £1300 to get the desired effect so I decided to cancel it. I had the same reply as OP offering credit for £749!!
So I sent this in reply:
Thank you for coming back to me, and for your offer of a full refund of £749 in Groupon credits for my unfulfilled service.
However, a refund in Groupon credits is unacceptable to me in this instance, as you have breached the distance contract between us by not fulfilling the order to me. I therefore request that you please provide my refund of £749 back to me in cash, refunded to the payment method used for the transaction (VISA debit card).
I do not require, nor am able to benefit from a ‘similar deal’ as my teeth are not suitable for treatment, as confirmed in my consultation. At every stage of the process I have been assured I am entitled to a full cash refund if I am ineligible for treatment.
Please note I have taken advice from trading standards on this issue, who advise me I am due a cash refund within 14 days due to your breach of contract.
I look forward to hearing confirmation back from you on this matter.
