Round about car accident

My opinion is that it was up to the lorry driver to make sure it was safe to enter the roundabout and the fact that they hit someone already on the roundabout means that it wasn't.

(Reading the OP did give me a bit of a headache, but I assume it was typed on a mobile phone with auto-correct.)0 -

How do you figure that? From what the Op has written the lorry came out of the second exit and drove in to the OP as she was heading for the third exit.
Even if the OP indicated left early the lorry still came out when unsafe to do so. I should know although not a roundabout but a T Junction I was hit by a driver who indicated left and then went straight ahead even had an independent witness it was still pinned on me (which is what I expected TBH although I fought for 50:50)0 -

As far as I can make out the OP was exiting a roundabout from lane 2 lane and was hit by a lorry continuing along lane 1, either because he!!!8217;d (wrongly) decided to turn right from this lane, or had joined at the closest exit.
As unfair as it is OP, be prepared for this to go 50:50. There was a similar case I read where someone exiting a roundabout was hit by an elderly driver who had decided to go all the way around the roundabout in lane 1. It went 50:50 because he was told that it was up to him to check the lane was clear before turning off.0 -
Because from the OP's account, the lorry driver doesn't think it's his fault and will contest the matter and in the absence of any witnesses, there will be conflicting and ambiguous accounts of the exact timing and position of the vehicles by the two parties.Svein_Forkbeard wrote: »How do you figure that? It seems fairly clear to me that the lorry driver is at fault, but the insurance process is another matter.0 -
but its ok for the lorry to enter the roundabout without it being clear to do so?
The lane that the lorry entered was clear, the OP changed lanes without checking to see if its clear, he failed to see a lorry.
Lets wait and see what the OP says, was it a large lorry, 40ft, big enough to see

Were you there then too, because it's not what the OP states in their post.sevenhills wrote: »The lane that the lorry entered was clear, the OP changed lanes without checking to see if its clear, he failed to see a lorry.0 -
Reading the OP - OP was indicating and looking ready to change lane for exit and the lorry joined unsafely and ploughed into them. So it should be the joining vehicle at fault. Sadly - it may end up going 50:50 if the lorry driver claims they joined and then the OP cut across them. The partner as a witness would probably be assumed biased.
There are so many of these described here - I wonder if nervous drivers aren't put off roundabouts altogether...I need to think of something new here...0 -
With such a big accident surely the police attended, did they question the lorry driver? Did they do any sort of investigation (they may not have with no serious injuries)? Any CCTV that might have captured what happened? Did the lorry have any sort of recording equipment that could be requested (assuming it wasn't wiped straight afterwards)?0
