Help! Left rented house, what's he legal position on bills

I did give correct notice, for the tenancy to end on 20th August. I've taken meter readings on electricity and water, why would I be paying for utilities he is using if I'm not living there? He's about to put it up to be rented out an dhoping to get someone straight in. He has all the keys and we have NO access to the property.

The threatening to hunt us down is because he's a complete psycho that wants control over us and he's beside himself where we're not letting him control us and have refused to give him our address.

Err, the fact you've moved out is irrelevant. It is your house until the end of your notice period.


You are responsible for everything until the end of the notice you've given (presuming this expires on 20th August as this is how long you're prepared to pay rent?). Just because you aren't using it doesn't mean you don't have to pay (water is not charged per usage as standard, electricity/gas has standing charges...)

I'm wondering if implied surrender could be at play here? Could it be argued that's he's accepted our surrender of the property? Please keep your responses kind, I don't need people being unkind to me on here

- we've emptied and cleaned the property
- handed over all keys and have no access
- grandad/landlord is entering whenever he wants without permission from us and is letting in estate agents etc
- grandad/landlord is having property redecorated

There's a difference between someone suffering with depression/anxiety and someone that actively tries to be cruel to people.

But couldn't it be argued he's taken possession as he's accepted all the keys and is letting himself and other people in whenever he wants and is having it decorated?

should have negotiated surrender at 2. and not allowed 3. or 4. till surrender agreed

Move back in and refuse entry to anyone.

It probably could - but you couldn't prove that it wasn't with the understanding you'd eg pay the council tax or contribute towards the utilities. Especially if your notice actually wouldn't take effect until the 20th Sept, it could be argued he was doing you a favour by letting you only pay rent until 20th August in return for earlier access to the property...



As you don't have a deposit to reclaim he's going to have to go to court to get any money off you. Which is difficult without the address. But you say he's harassing your family? How, if he doesn't know where you are?



I don't know if the OP could give him a PO box or "care of" address to enable correspondence without revealing their own address - would that work from the POV of court? And getting Grandad to either make a proper claim or leave OP and family alone?

Everyone seems to miss this point- THE NOTICE WE GAVE IS VALID FOR TENANCY TO END 20th AUGUST. So notice isn't a problem as it's valid and we've paid the rent.

We gave back all the keys as we needed to be done with the property and didn't want any link to the house or him. I have a child with disabilities, I'm not moving back in to be petty when I've just bought a house!
He's harassing my family as they live near him and he's my dads dad!
He hasn't said he's pursuing us for money, but I was trying to clarify the legal standpoint on it all incase he did. We turned everything off so water and and electricity won't be running, it's only being used by HIS decorator, so I can't see we should be paying for that when he has possession of the property? And it's my understanding that as landlord he doesn't have to pay council tax because the property is empty and unfurnished? Council asked on council tax form the date we moved out, which I told them so I'm assuming it's down to them how it's all worked out

In reality then you need advice on harassment not tenants rights and obligations.


Ask your family to report it to the police.
