Hi


I received a county court claim from one of the parking companies
I have read the newbie post as advised.
After reading it, I still have a query and I was hoping if someone could advise. The parking event they are taking to me to court for, happened almost 1 year and a half ago. It cites a leisure complex, there are restaurants, cinema, bowling, etc. I very rarely go there and have not been for months and months, it could have been xxxx driving or xxxx, I really am not sure, of course I am the registered keeper
My question is, how do you defend it? saying it was too long ago and you cant remember and refuse to give the details of others that could have been driving? if it gets to court, do you insist in that to the judge?

    Post #2:there covers Court claims from the receipt of the lbcca right through to the hearing

    After getting acquainted with the process your first job is AOS.

    A step by step guide to this is set out in the same post

    Throughout here you are advised never to reveal who was driving

    You need to edit your post to remove details of who the driver may have been

    The ppcs monitor this forum and can use posts in your thread against you

    The guide to court is in post 2 of the NEWBIES, written by a poster called bargepole. That's what you should be looking for, and following the step by step guide therein.

    Have you done AOS?

    That post does show you how to go about constructing your defence with links to others.

    You are defending as keeper, but your suggested defence in your OP won't work!

    Creditors have 6 years to start legal proceedings
  • I am going to court with a similar situation where the driver could be one of three people. I have witness statements from them stating that they also can't remember dates they might have driven but verifying that they were legally entitled to drive the vehicle e.g. providing copies of insurance etc. If the PC attempts to chase those people then they will have the same issue - identifying the driver with whom the 'contract' was made on each particular occasion.

    Not knowing who was driver is covered by POFA!


    So be sure you know whether or not the PPC is using POFA (and doing so correctly) to pursue the keeper before using "not knowing who was driver" as your only defence point!
