    PS - they may have asked for a set-aside; that doesn't mean they've paid the fee yet. Also, if these two "arms" of Paypal are separate legal entities (i.e. they have company numbers and report financial results to the respective authorities within the countries in which they operate) then you can't make a claim against one if your contract was with the other. I know this doesn't help the OP's claim, but it is the status as I understand it - there's no point in giving the OP false hope.

    I have no authority to tell you what to do but I can give you friendly bits of advice, can't I?

    My advice is not a false hope for the OP but from the experience of others, I thought it might help him. Nobody can guarantee the result of a lawsuit but we can only share ours and others' experience. I am also fighting to PayPal EU right now so I am in the same boat with him.

    Great news guys, PayPal are now offering me a full refund for my lost payment plus the court fee in order for me to discontinue with the claim against PayPal S.A.R.L et CIA, they are now listening to the power of court.
    They still claiming that they followed the right procedure when closed the case in the seller’s favour. But what really makes me laugh that they are offering me a full refund plus the court fee as a gesture of goodwill with a condition of keeping the offer confidential and not to share my experience in resolving the issue with others.
    I still want to continue with the claim for the fact that they don’t want to admit making a mistake and miss-treating me for the past few months plus I will proof them my innocence and teach them a good lesson and force them to pay me back my money.

    What do you guys think!

    Surely I will get better result, I will get what PayPal offering plus the payment interest for the past 11 months and I will ask for a compensation as Paypal accused me of theft and treated me badly, more likely I won’t get any compensation but at least I will teach PayPal a hard lesson.

    You won't get compo. Going to court carries a risk. The time, effort and potential risk makes a heck of a gamble for what essentially amounts to just the interest on your claim.

    Not only that but you may well not get all the costs awarded to you. On the parking board we regularly have posters win their case but fail to get the costs awarded to them. It's highly discretionary.

    You could win and still end up worse off. Whilst principals are fine don't lose sight of the bigger picture. Walk away with your money and dignity intact.

    Simply tell them that you believe that all the relevant information is already publicly available.

    I agree with waamo. On top of this, think about how you'd enforce the judgment (should you win and they fail to pay) ... tracking down Paypal assets in the UK won't be easy.

  • Guys, if anyone would like to take PayPal to court in the UK, ensure to use the correct company name “PayPal (Europe) S.A.R.L et CIA S C A” and you can use their Uk legal representative address or you could get a permission form the court to serve your claim out of the jurisdiction and use PayPal’s address in Luxembourg.

    If you have a good reason to take them to court do it ASAP as PayPal will not listen to you or anyone but they will do anything to resolve the issue once you start your claim correctly before the hearing date.

    I am more than happy to assist you guys with your claim only if you are genuinely been treated unfairly by PayPal.
