Paypal and small claims court

In February my Paypal account was hacked into and 7 fraudulent transactions took place, 3 of which were refunded by them and 4 were not. I paid to take them to the small claims court and have just had a letter from their solicitor today they want the claim struck out. They stated that my claim was made against Paypal and not Paypal Europe. I can pay an extra £100 to the court (non refundable) to change the name to Paypal Europe my concern is that they would want the address changing aswell to Luxembourg in which case i cannot take them to court here. Has anyone experienced this before?

    PayPal (Europe) Ltd have a UK address. That should be perfectly acceptable for service.

    Which address did you serve the notice to?

    Their legal team will try anything. if they want the claim to be struck out, they have to ask for a hearing. Then a judge will decide. So you can just carry on with the claim, and when it goes to court, if the judge agrees with it, then you can make an application there to do it.

    i am not sure how much you are claiming for, but another option ( depending on the cost ) might be to discontinue this case and start a new case.

    When you log to paypal, it doesn't say 'Welcome to Paypal Europe, ' or 'Welcome to Paypal UK'. It just says welcome to Paypal. So as long as the address you have sent it to is the correct address, they can go whistle.

    The address i gave to the small claims court is Whittaker House, 2 Whittaker Avenue, Richmond, TW9 1EH.

    Thanks for the advice. I spoke to the County Court today and i think she said she will send something in writing to me regarding the next steps once she has received all the info from Paypal's solicitor. Its ridiculous it's only £590 but its the principal now, i'm not giving up. I won't do anything yet then, i'll just wait, thanks again

    Why did they refund some but not others?

    Gavin, in the many phone calls i made to them, the reaosn they gave was that each transcation was dealt with by a different agent at Paypal and it all depends how they deal with it, that is the only explanation they could give to me

    The address listed at Companies House is 5 New Street Square, London, EC4A 3TW

    I would use that one as it's their official address.

    I will use the address you provided, but shall I address it as PayPal (UK) or PayPal (Europe) or just PayPal

    It's important to get the name of the company right. Their official title is PayPal (Europe) Ltd. Their company number is 04056498
