Ok, mediation hasnt come through. Ive had a 'notice of transfer of proceedings' they have told me the court ill be going to. Ill have a read on the threads regarding the process and see how to go about it. Im a bit worried because i dont know if ive missed the deadline to get evidence in. Ill see if i can take my case into court with me. Its just a bit scary as never had anything like this before.
read through post #2 of the NEWBIES FAQ sticky thread
read the BARGEPOLE timeline and the LOC123 guide
usually the reason somebody doesnt know something is because they havent studied those guides
and no you cannot just take stuff in on the day, it will likely be that the claimant would reject submissions on the day and the judge would not be happy either
the WS and evidence submissions are usually a few weeks before the court date, so check your paperwork for those dates , a fortnight before the court date is the usual limit, but could be earlier
when a court is allocated (near you) the PPC has to pay the court fee to progress it and you are given the deadlines for evidence and WS statements at that time, so should be on those papers when they are served
I suppose the question now is
was a date set by the paperwork for the claimant to file their court fee ?
assuming it was set, then this is the next deadline, and anything else comes after that
ps:- its never happened to me before either, nor a lot of the people who will reply to you0 -
As mentioned in post #17, you need to read your Notice of Allocation which will tell you when you need to supply a witness statement and evidence.
Please don't ask again "what is a Notice of Allocation?" have a look through all your paperwork from the courts.0 -
Ive already returned the directions questionnaire. I returned it after a letter called general form of judgement. They had given me 7 days to return the questionnaire.
The mediation was offered which i took, the letter said if i didnt hear in 28 days then it wasnt an option. The latest letter is the court letter. Transferring to my local court, it says it will be allocated and then ill get the notice with some details of the judges direction.
I understand you get a lot of questions and im trying to read through the threads.sorry0 -
so whilst you are waiting for those directions , court and court date, look through all the relevant info on here, then get your WS and evidence ready in case the court fee is paid and it goes to a hearing
once you get those directions, you will know what to do as it tells you
the BARGEPOLE timeline also tells you what happens and when , so it is crystal clear that you have not read his section 5)0 -
judge Taylor or Grand? i am going to use this a part of my defense- currently have the small claim pack and offer of mediation-can you pm me??? thanks0

This thread is a year old. The OP seems to have forgotten to update it.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Hello there,
Do I need to start a new thread to ask for help at mediation stage? I have done considerable work on my own and enlisted the assistance of a friend who was a solictor. She now recommends going to court and asking for the hearing to be local to me. Obviously I am concerned about my newly repaired credit rating (hit due to difficult circumstances) don't want to go backwards in that respect. Reading this thread here I see that mediation is not recommended. The detail on the last correspondence said that the mediator will be impartial. Is this not the case? I would in any case only offer the mediator the £1 that I apparently should have paid. Now asking for over £200.
I initially ignored everything. Next I filed a defence with the court. Now being offered mediation and I have until 27th August to respond.
I don't want to bog this down with the circumstances, but can do so if required.
Thank you for reading.0 -
Chelostar, you have piggy backed off someone else's thread and a year old one at that. You will get bespoke help if, after having read the NEWBIE sticky, you start your own thread. There is a New Thread button on the front page of the forum.0

chelostar, you started your own thread back in June after being similarly chastised, and now you have done it again. Why is that?0
