    So are ce.l likely to take the mediation call? They are likely to do what they can to stop it going to court? If i wasny applying for mortgages i wouldn't worry about court but think that's actually the best route... if they even take it that far

    Yes because they see you as easy prey. And the Mediator will press YOU to settle.

    A defended Court claim doesn't affect mortgages, even if you lost & paid. No CCJ, nothing at all.

    But by being here now, you should be able to turn this around, we hope.

    Stop thinking about damn pointless mediation!

    And it isn't a Bill. You will not be paying that inflated sum. I hope we can help you rescue this one at WS stage, with evidence and a decent statement.

    The mediation letter said they didn't need any further.defences. am i allowed to submit something further if i find an example on the threads. Can i send it to the court email?

    You need to produce a witness statement and evidence to support your case.

    When does your Notice of Allocation say you should submit 'documents you intend to rely on'?

    Have you looked at other CEL threads to see what's required?

    Has a date been decided yet for the mediation?

    Whats the notice of allocation? Sorry if im being a bit stupid but i dont really understand this whole process.
    Ive looked for cel threads but there are so many different posts. Is there a sticky thread i should be using?

    Post 2 of the NEWBIES has a step by step guide to court written by a poster called bargepole. That's what you should be looking for and following.

    As above, get rid of the mediation. If it is done by 'phone, on the date of the mediation call you simply say you offer nothing, and you are going to win in court because MSE are guiding you through this unregulated scam.
    You could make a drop hands offer. Tell them that if they drop the case, you won't go pursue them for unreasonable costs.
    Get your MP on board as well, just like it tells you to do in the NEWBIES.

    CEL always add £136 extra as contractual damages, taking the original £100 to £236.


    This was taken from a recent thread where the judge threw out their claim.

    IT IS ORDERED THAT
    1. The claim is struck out for an abuse of process

    Reasons:
    the claim is based on an alleged contractual parking charge of £100. The amount claimed on the claim form is £253.22 and on particulars of the claim £328.22. This inflation of the considered amount is a gross abuse of process.

    2. this order having been made by the court pursuant to Rule 2.2 of the civil procedure rules 1998, any party affected by this order has a right to apply to set aside, vary or stay it by application made not more than 7 days after this was served on the party making the application.'

    Ok, mediation hasnt come through. Ive had a 'notice of transfer of proceedings' they have told me the court ill be going to. Ill have a read on the threads regarding the process and see how to go about it. Im a bit worried because i dont know if ive missed the deadline to get evidence in. Ill see if i can take my case into court with me. Its just a bit scary as never had anything like this before.
