Parking ticket now at mediation stage

Hi Everyone,

I wish i would have found this earlier

I have read through the original posts that are on the forum at the top but my situation is more advanced and to be honest i think i may have shot myself in the foot

I recieved pcn and ignored letters. Was passed to CEL and then i got Northampton court letter. I responded and asked to defend as i believed the parking signs werent visible in the dark (fine was at 9pm) i mentioned that i was not aware of the parking charges and that since i had found out that the place i was visiting actually offer to pay the parking so if i had known i would have paid. It was £2 or something. I said i exited via a pedestrian access and missed any signs. I said the car park was always free in recent times i had parked and i also said that most car parks charge to 6pm anyhow. I know i could have used the great templates but i didnt realise there was help for free. I feel i may have already ruined my chances of winning but please let.me know if not.

It was passed through and then i had a directions questionnaire which i completed and sent back. I saidid take mediation. Ive since had letter explaining process, it takes 1hr and goes to cpurt if cant agree.

I gave my court location preference in the questionnaire and so if mediation isn'ttaken ill go to court now.

Im feeling very stressed because i am trying to buy a house and my mortgage application has beem accepted but they do a further check before we move in october and im worried ill lose and get a ccj and mortgage will be rejected when we want to complete.

I feel like i should speak to civil enforvement and pay but read the threads telling me not to contact them.

Ive not had a court date and see that sometimes they drop the cases. Not sure if mine is poorly defended and so its an easy win for them. The letteri had said the court didn't need further information. So may have missed my chance.

Any advice would be amazing as its really worrying as my financial adviser says it can mean we may not get our house if i get a ccj. I did read aslong as i pay within 28 days its not a ccj- anyone who can confirm would be great!

    correct

    if you lose in court , a judgment is filed

    you pay it off , IN FULL, within one month and it is struck fro the register, NO CCJ

    its not paying the judgment within one month that leads to a CCJ on your credit file

    if you cannot agree anything at mediation (which is usual) then take it to court with our help, trying to get them to back down , or you try and win

    but if it all fails , pay up , IN FULL , asap , to avoid the CCJ

    For the mediation should i offer to pay a certain amount? I think with all the fees they have added on it is around 500 to pay.

    frankly, I wouldnt pay a penny and let a judge decide, if it gets that far


    the choice is yours however , but I certainly wouldnt be offering a lot of money , maybe £10 to cover paperwork only (but as I said, I wouldnt pay a penny)

    they can "try" to add what they want , however the charge is £100 + court fees , so if you loose they should get no more than £175-£225 ,

    e3xpect cel to ask you to make an offer , the week before , they will try and ask for £150 is to stop court , play poker keep a stern face and say sod off

    if you defence is good they will back down the day before

    65430 tickets this year 381 court appearances , and they often get beat

    NO, absolutely NOT. Newbies need to know not to take uninformed advice from other newbies.

    Jeez, even though you are on a forum where we NEVER lose v CEL and never even have any claims, when a case is properly defended. And it is made clear NEVER EVER phone a parking firm. NEVER.

    You should be forgetting 'Mediation', it's pointless. Look ahead at Witness Statement and evidence stage which you MUST get right; a statement based on your defence but with evidence as to why you are not liable.

    You have gone about this so wrong so far, please don't compound the error by missing WS stage, or phoning CEL up thinking you can negotiate, or doing Mediation and getting bullied into a settlement.

    Hi,
    I know i got this wrong and after reading through i should not have picked mediation but its too late now, its done.

    My defence....
    I dont believe i should have to pay this fine because up until recently this car parl was free. I didnt realise that a fee was payable, if i did o would have paid the 2.50 charge. You will note that i was on the car park late in the evening and normally most car parks are free at this time.

    I was visiting Khans (restaurant) and now they offer to pay parking anyway and so it wouldn't have been an issue.

    It was very dark and i drove in the entrance but exited by foot by the pedestrian access which wasnt sign written.

    I would hope at the very least due to human error the charge can be reduced if not removed. I know a number of people in the area have had tickets in the same situation.

    I believe the orignal fine is 40-60, which i cant see is fair as i would have had to be parked for a number of hours which i wasnt.

    Thanks all- if you think its too late please dont waste time just let me know and ill just go to court. Aslong as my credit isnt effected ill havd to pay if i lose!

    It is not a fine, it is a scam

    This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors.

    Parking Eye, CPM, Smart, and another company have already been named and shamed, as has Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each year). They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct

    Hospital car parks and residential complex tickets have been especially mentioned.

    The problem has become so rampant that MPs have agreed to enact a Bill to regulate these scammers. Watch the video of the Second Reading in the House of Commons recently
