I would email them. It is your choice and I don't want to put you off defending this one - nothing to lose!

I am just not certain you will win, and I wanted you to be under no illusions about the road signs you are relying on which really have nothing to do with any car park. You may have luck with a good court (Manchester, Guildford or Skipton are brilliant at seeing off PPC claims more easily than most, if you are near any of them!).

If thinking of making an offer, start at £30 to cover their costs at POPLA.

PE are known to settle for £60 but obviously you don't offer that immediately. Or at all, if you prefer to get your own back by costing them more to go through the court process and man hours, and the cost of a legal rep they will send, to collect £175 from you if they win!

    Thank you.

I e-mailed them yesterday and waiting for their reply.
I believe my County Court will be in High Wycombe.

I will see what they say and think if I should settle or go to court.
If I lost, then I will cost them more, but they will also cost me more :)

  • I got a ticket for Hallsville Quarter also. What was the decision for the appeal you made? Were the grounds you made the appeal for accepted to POPLA ?
I actually was trying to pay online and I couldn't find HALLSVILLE QUARTER in PaybyPhone site.

This is not a thread to look at regarding how to win at POPLA.

Please read the NEWBIES thread (see my signature below).

If you can't see my signature words below and see where to click at the top of the page, you need to view the forum properly and as it's intended to be used, on a laptop and never a phone.

    Hi again,

So I sent my response to their letter before court on 7 Dec and got an answer on 2 Jan that the Parking Charge remains due, with their explanation why (that the signage conforms to BPA regulations, ect.).

I replied on 8 Jan that I don't agree with their position and that I offer £30 (marked without prejudice save as to costs) to avoid further costs on both sides also noted that it's no an admission of liability.

I got an e-mail from them on 9 Jan saying:
"ParkingEye can confirm that we have received your response to our Letter Before County Court Claim and that we will respond within 30 days of receipt."

30 days has passed and I didn't received any answer from them: no e-mail, no letter, checked my spam folder nothing.

I hope that they just let it go, but if they didn't, can I use the fact that they didn't answer within 30 days to dismiss the case (charge) or as a defense in Court?

Not having marked the offer WP.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Could you please clarify what it means?

The refused my offer yesterday as it "is significantly less than the outstanding balance". I am going to make them one more offer and then will see what to do.

I mean High Wycombe court is a good court for Defendants v PPC scams.
