It's very much like re-stating your lost POPLA appeal, so PE will not cancel, but at least you will have tried to narrow the issues under dispute and can also use that as a crib sheet at your hearing in 2019.
Really not sure that you will win this one, as I said when you did your POPLA appeal. You can't reasonably expect that a car park has the same terms as on the public highway you drove along to get there.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Is it very likely that I would have to pay the claimed £100 plus other costs (court fee, ParkingEye solicitor ect.)?
I read here somewhere that even if lost, courts usually lower down the claimed amount?
Also, will I get another reply from ParkingEye (to my reply) or if they would not cancel the PCN they will file the claim directly to court?0 -

If you lost yes £175 payable within 28 days or what the court orders

Will they write before issuing court papers ? Well if they were professional they should but parking scammers are not professionals0 -

Yes, as per a claim £175 would be payable., the court and legal fees are correct and the contractual charge is £100
Some legals go well over the amount of £175 and that is where a judge will reduce the claim

Why other legals go over £175 ..... simple, they are trying to extort extra money ...... in your case NO
If PE have not answered your questions then they must and you need to remind them, otherwise you inform the court that PE has not provided info requested0 -
Thanks, now the £175 is clear.
In POPLA appeal they just answered that:Please note, the permit signage provided by the motorist in their photographic evidence is of a council sign, this is on a main road not near the entrance and therefore is not a part of this car park.
ParkingEye ensures that all its signage is clear, ample, and in keeping with the British Parking Association (BPA) regulations.
The signage at this site demonstrates adequate colour contrast between the text and the backgrounds advised in the BPA Code of Practice, you will note the colour contrast at this site is black text on white background.
There is sufficient ambient lighting on site and we have highlighted some of the lighting poles within the images. (Enclosed)
There are also signs at the entrance to the car park which adjoin an illuminated public road and so we can confirm that there is sufficient ambient lighting at this site."
Plus something about ANPR cameras.
I am explaining the situation in regards to their reply and photos in more details that POPLA and also try to claim that there was no contract or it was invalid or voidable.
I would like to get from them one more letter with answers, before going to court. Depending on their answer I would consider offering them to pay less than the claimed £100, of course without admitting liability. I do NOT think that I will loose the case, but according to information provided in my topic my case is unsure. Not sure, if I want to risk it.
I add the following at the end of my answer:
"In case should you not cancel the PCN, before filing a claim to the County Court, I require a reply from you with answers to all of my above points"
Is it ok or should I use different wording?
