    I wonder what Mr Simon Renshaw Smith will say about this?. remember when he called a judge "a disgrace to the legal profession" because Excel lost?

    Suspect that might just confirm the "contempt" element.
    They'd be hard pressed to argue the DJ was wrong to make the finding or that the costs outwith unreasonable costs orders - especially since they were trimmed a little. I think this will probably stand. We shall see

    They would need a full transcript for that so the OP might wait a while to see if Excel apply for one. My understanding is subsequent copies are cheaper.

    They would be mad to appeal that - obvious evidence tampering is nuts

    I really couldnt udnerstand why they WOULD remove log entries - surely it only helps them to show there were successfully entered visits during that time??

    Well done L. Is there a transcript planned as it would be useful with the other Excel transcripts to show

    * a history of faulty equipment
    * a history of submitting misleading evidence
    * a history of being banned by the DVLA for misleading paperwork.
    Agreed... It would also be a bl*ody good read. Despite the costs awarded I can't ask the D to fork out for a t/s. She's a hard working NHS midwife who's been stressed out for months with this case looming over her. I hope she enjoys every penny of Renshaw-Smith's money

    @Lami - The Prankster used to fund some key transcripts - whether that is still the case, I'm not sure, given his extended spell of absence from his blog page.

    If you think it could be of future significance, I wonder if a JustGiving appeal might raise the required amount? I'm sure regulars would happily contribute.

    Frankly stunned excel sought to try and exclude the other statements too.
    The manager's WS was actually written for another similar case. The other member's WS was written specifically for this case but BWL tried to say that was for another case too.
    The contempt point is interesting. Not sure if that'll go anywhere, but would be great to have an update on that in due course.
    I'll get the D to ask the court about this in a few weeks. Not sure if they'll tell her anything but as an 'interested party' I would assume she's allowed to know.

    Same C and car park but different circumstances. I beat them twice, same court and judge.

    Haha, I wouldn't go that far. I've actually had a few rough rides there from Judge Wright when I repped other cases. Still won them all though :)
