    Even if you lose at PoPLA you are likely to win if this goes to court. Judges are becoming aware of the scam and tend to view these no/wrong VRN cases as trifling, and the Law does not concern itself with trifles.

    CEL will probably go to the wire on this and then pull out, at which time you can ask the judge for unreasonable behaviour costs citing scores more instances of CEL abuse of the court,.
    You never know how far you can go until you go too far.

    Unreasonable behaviour costs - never heard of that - thanks I'll look that up.
    It certainly has been more bother than it's worth for the driver - loads of friends and family have (quite rightly) recommended that he pays and forgets about it. But for me this is about the principle.

    Many communications with LL,

    1) Call on day of notification - LL not interested, "Take it up with CEL it has nothing to do with me" - driver pointed out that LL has a business partnership with LL therefore he does but was not wiling to do anything. Driver asked if LL gets a proportion of the fine - LL did not answer this question.

    2) Called just before POPLA appeal, LL said bring the fine in - driver posted proof of purchase and copy of PCN in but LL said he did not receive it - driver offered to send electronically but landlord only accepts documents in physical form.

    4) Driver had evidence dropped off at pub but LL not confirmed receipt.

    The establishment concerned is getting a lot of negative reviews on Trip Advisor so I do wonder how long this can go on.

    CEL have submitted the following...
    RESPONSE TO POPLA APPEAL
    Surely you've won by now, if that was the first week in August?
    Then it's a printout of REPORT OF REGISTERED VEHICLES AT CAR PARK AT
    Interestingly - while they black out the number plates - they can still be cut and pasted
    You mean when you cut & paste, you can read a list of complete strangers' number-plates, and match the data to payments made on a certain date?!

    Woah, one for an ICO complaint.

    Sorry to hear. Can you let us see the assessor's decision please?

    Please spare us the usual mahoosive wall of POPLA text by simply copying and pasting the POPLA 'raw' decision. Please help us to read this (given all the reading regulars have to do - just not your thread alone), by pressing that new-fangled 'paragraph' button on your keyboard (aka the 'Return' button!) - surprised how many newbies here seem to have little idea what it's for, or how to use it. :)

    As above then, as your first fightback, the Information Commissioner's website. Don't rush it, no setting the scene or griping about losing at POPLA.

    An ICO complaint is PURELY about data misuse, so it's purely about CEL providing an insecure list with dozens of people's VRNs on, which are all identifiable personal data connected to individuals who have also been scammed by this cash cow, and some whose data should, arguably, have been swiftly erased by CEL because those persons didn't get a PCN.

    Secondly, re the POPLA evidence:

    Did they provide any photos of the signs in the dark, or did you show POPLA one in the dark that was clear to read (big mistake, if you did their work for them). If you feel their evidence missed out signs in the ark, then complain to POPLA that the Assessor has ignored the fact that CEL failed to show evidence of how signs look in the dark (see the Assessor's decision above yours in POPLA Decisions...the one about the operator not showing signs in the dark!).

    You can complain to POPLA. It's pointless in some ways but POPLA need to hear it.
