Am I missing something here... your excess is only for your own repairs so if the damage is , as you say , so slight just pay for a repair.
As far as the other party your insurance have to settle any claims and there's no excess involved ??0 -

Thanks for the link I will have a read through it as I think I will most likely contest this. It just doesn't seem to add up. First they tell me the other party is claiming injury and than suddenly I have a massive repair bill. Why would they offer a 10% discount to receive payment by the end of the month also...0

XS policy wording is possibly a defective contract, as it does not offer any repayment terms. I don't think it actually complies with UK consumer laws. This was the case, the last time I read the policy wording. Perhaps they have changed it since ?
Arguably, you could offer to pay the £3000 back over say the next 10 years and there is not much XS Direct could do about it. It is not as if they could take it to court, if the contract is not specific enough. They would be on dodgy ground making any adverse marks on any official records against you.
Have a read of the policy wording and any documents they issued. Does it state any terms about repayment of the excess to them ?The comments I post are personal opinion. If you have a problem with any organisation, enter into their official complaints process at the earliest opportunity, as sometimes complaints have to be started within a certain time frame.0 -
I've had a read and it seems that they keep repeating that I am liable to pay up to £3000 and if I don't pay in time I will incur extra charges. They have not outlined the extra charges and neither have they written anything about payment plans. If your are interested to have a look the policy is available to read online on the insure your motor website. It is around 44 pages though! Main part is the repayment of excess bit...I've drafted a letter which I will send off to them today..They never even asked to see photos I took after the accident which show the cars are barely even touching..0

If you are ordered to pay by a court you also must pay all the court fees, the claimants allowable expenses plus interest from the time the money was due till the date you pay it
In fact your OP says they will accept less if you pay them promptly!
Equally you don't have to pay any bill in full if you dispute it, so should they take court action against you then you will be able to defend it in court if you can show the claim cost less than they say they did.
(But note that when you are to blame then you have to pay all costs incurred over the incident - not just the repair bill)0 -

The car infront of me thought they could make the lights but then they decided they couldn't and braked a significant amount away from the light. I then had to brake fast and even though I was slowing down already and was at a significantly low speed (less than 5mph) our bumpers touched.
The insurance company sent an engineer and in the report they say that there isn't any damage to the car and that they cannot see how this could have caused the damage that the third party is claiming, they still went ahead with the costs and expect me to pay £2000 worth of a £7000 claim (which is a load of rubbish). They also say that the guy is claiming whiplash which I didn't even hear about until the inspector came round to talk to me.
I am going to take further action because what they are doing is not right - I was just wondering what direction were going with this and how the outcome was looking, so then I can decide on the best action to take myself.0 -

So has your insurance company agreed to pay the other £5k of the complainant's claim?
If so, £7k of damage to another car which you submit you hit the bumper of at less than 5mph doesn't make sense, sorry.
Why would your insurance company pay out £5k for damage to the third party car, when you say the engineer could identify no damage sustained???
Why would anyone make a claim for £7k (not including medical injurires) if their car has no damage? That will only hit any NCD they may have and hike thier next years premium (not to mention any possible criminal action against them that would probably result)
What damage to your car was sustained in this accident?
