Apcoa appeal rejected

Hi All,

I appealed an Apcoa PCN for parking on Chippenham station in April, I had paid the £50 fine a few weeks ago to avoid the price increase (yet I now regret doing so after finding this forum!)

Reason for the fine was due to paying online for the wrong car park, the pricing is the same across all car parks however I paid for Car Park 3 but I was parked on Car Park 1. An honest mistake which I outlined in my letter after paying the fine. However they have said the following, that the t's and c's of the car park clearly state that a valid payment should be made...driver's responsibility to ensure they've purchased the correct ticket.

Is there anything I can do to appeal this letter and ideally get a refund of the money I have paid. I don't believe their claims are valid as they received the correct amount of money regardless of where I parked! I haven't received a 10 digit code for POPLA on any of the two letters from them, will I need to write back to request one?

    You've paid a scam and that's it you've learned a hard costly lesson, they won't give POPLA as the car park will come under railway bye-laws so is not relevant land.


    Only the TOC could have progressed this through court, not APCOA and they wouldn't. APCOA don't do court full stop, you have been conned!

    Now is the time to chat to your MP about the scam.
    You never know, if he/she is a hotty wanting to be
    voted in again, he might get your money.

    Also what is the exact explanation for me being 'conned'? I can't believe there is nothing I can do after this point?!

    There is no template as such, you just tell your story in your
    own words and make sure the MP reads about the new bill

    There is a lot you can do to TRY to get your money back
    but sadly nothing that works.
    They have your money and they will keep it, to the point
    you will be ignored

    Thank you, I will give that a try and hopefully something will come of it. Just so upset and can't quite believe that these companies are able to do things like this with nothing really available to help you aside from this forum it seems!

    You were conned because it was never a fine, NOT to be paid an we always beat APCOA at POPLA appeal and it's so damn easy. You were taken in by a scam fake PCN and cannot now appeal, you wasted your money pointlessly.

    At least next time I'm sure you will come here first and keep your money in your pocket!

    Before you write to your MP watch the video.

    This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors.

    Parking Eye, CPM, Smart, and another company have already been named and shamed, as has Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each year). They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct

    Hospital car parks and residential complex tickets have been especially mentioned.

    The problem has become so rampant that MPs have agreed to enact a Bill to regulate these scammers. Watch the video of the Second Reading in the HofC recently.

  • Apologies - I HAVE read as many of the threads as I can but am unsure what to do. Received APCOA fine (PCN to Keeper through the post, nothing on the windscreen) as paid for parking at railway station carparkbut Ringo somehow put the wrong parking code in. Appealed for this reason - did not admit to be being driver but did say husband paid the fine as he was the driver  - dammit). I  Emailed  my appeal and  the acknowledgment said I would hear by email within 35 days. I did not hear from them and checked all inboxes. Assumed appeal upheld. 46 days later a letter was sent for debt recovery. I was away and didnt received it. Had another debt recovery letter later so wrote and said I had not had a response to my appeal and so was not paying until the appeal was responded to. Phoned ZZPS and was told APCOA have responded to the appeal. I requested copies of the response and was told I couldnt have them unless it goes to court! Have now had solicitors letter. I dont have a POPLA code and I dont know what to do next. The threads dont seem to have anything about an appeal that wasnt ackknowledged. Whats my best course of action - what letters and templates do you suggest I use please?

    arjayw45, please do not hijack another poster's thread. 

    The sticky thread for NEWBIES that asks you to read it first before posting answers most of your questions. If you need further help please start your own thread where you will get bespoke help. You will not get any help here on this eighteen month old thread.

    The fact that you are calling this a fine and have contacted a debt crawler despite advice to the contrary in the NEWBIES tells me that you have not read it thoroughly enough, so you need to d that before starting a new discussion.
