    I think CPW would have a valid defence if they could show that they contracted with VM legitimately, and in good faith, but VM failed to fulfill the OP's specific airtime order through VM's negligence.


    And... I've just checked my account and I have the same issue as the OP. :(:)

    I don't. Your contract was with CPW. The Virgin contract is separate and it wasn't Virgin who offered the deal. The headline on this thread is dubious and probably incorrect. Who actually advertised the deal? Sounds like it was clearly CPW and not Virgin.

    If it were solely a question of "false" advertising, then I would agree with you - it's down to CPW, because VM cannot be expected to control what CPW publish. But a question of fulfillment could go either way, I think.

    Anyway, VM have referred me back to CPW, so it looks like I'm going through the same process that the OP did.

    VM are quite correct and it's up to CPW to fulfill what was offered. Suppose I offered you a new car for £5 but the dealer charged your credit card £15,000 - would you really try and enforce the contract with the dealer??

    I'm not sure your analogy works. This is more like being sold a car from a Dealer, acting as an agent for a Manufacturer and then finding out that the Engine in the car is not the one you ordered. In those circumstances, it could go either way in terms of liability, I think.

    Predictably I am now on hold with CPW whilst they contact VM for me. Their hold music is awful.

    ...Still on-hold whilst the two call centres battle it out...

    ...Now being transferred back to VM...

    ...Now on-hold at VM... (just as well I have lots of minutes)

    Your action would be against the dealer, not the manufacturer.

    I'd try the phone and then put it in writing. CPW tend to take people more seriosuly when they think they mean business.

    I will just work the problem until it's fixed. If it starts to drag, I will escalate to Director level.

    I didn't do that well - they couldn't resolve it without charging me more, so I cancelled.

    They said it had been mis-sold by CPW.

    The saga continues.
