    I do not understand why, if a set aside is granted due to a change of address, the £255 is not refunded there and then.
    You never know how far you can go until you go too far.

    because the £255 is the fee that you pay the courts for there service/time

    if you want that money back , you have to claim it off the other party

    You write to that Judge now,

    I've just written and sent off a letter to the DJ who had passed the set-aside and had reserved teh costs.

    I'll post back once I hear back from him.

    Hi guys,

    I haven't received a response from the judge till date. Am bit of losing patience on this now. Its frustrating that I get to loose the reserved costs too because CEL used this loophole of not paying the court fee

    Isn't there any other way? The costs were reserved, aren't they enforceable? Also, am thinking of filing a counter-claim on CEL in the small claims court, with reference to this case. Would that be a good thing to do? Any harm possible there, as in, could it backfire?

    Hang on you only wrote to claim your reserved costs during the past 10 days (ish) and there was a Bank Holiday in between! I think a court Judge is entitled to a bit more than a few working days to respond.

    Great advice earlier to wait for judge's response, it finally came in the post. A hearing has been set for costs pursuant the set-aside order!

    Now scheduled for 9th Oct 2019! - 15mins allowed, as compared to the 1.5hrs assigned for the hearing that was canceled due to non-payment of fee by CEL. So, I believe this will focus solely on my costs, as compared to the whole application?

    Just got off the call with the County Court - they've confirmed that this is not a trial hearing, but a hearing just to settle the reserved costs. Hence the 15min audience only and no £25/- trial fee to be paid by either party.

  • COURT VICTORY AGAINST CIVIL ENFORCEMENT
    As I wrote in a previous post I had many threatening letters from Civil Enforcement . Intimidating Bullies who manage Birmingham Botanical gardens car park. After letters from Civil Enforcement I received further threats from debt collection agencies ,then Solicitors acting on their behalf. After ignoring all of them Civil Enforcement took me to court in Worcester.
    The Judge ruled,that he was satisfied I had received verbal permission from staff members to use the car park. This constituted a VERBAL CONTRACT ! Although I didn't register on their machine. Which did overide Civil Enforcement s contract to manage the car park as Botanical gardens are the owners !!
    I assume this has set a legal precident. Therefore anyone who gains verbal permission from any staff member to park should not have to pay Car Park Charge Notice ( CPN)
    THE JUDGE ORDERED CICIL ENFORCEMENT TO PAY COURT COSTS , LEGAL FEES
    AND £72.50 TO ME AS EXPENSES
    THE CHEQUE ARRIVED YESTERDAY
    THANK YOU CIVIL ENFORCEMENT. DINNER IS ON YOU !!!!!!
