COURT VICTORY AGAINST CIVIL ENFORCEMENT
As I wrote in a previous post I had many threatening letters from Civil Enforcement . Intimidating Bullies who manage Birmingham Botanical gardens car park. After letters from Civil Enforcement I received further threats from debt collection agencies ,then Solicitors acting on their behalf. After ignoring all of them Civil Enforcement took me to court in Worcester.
The Judge ruled,that he was satisfied I had received verbal permission from staff members to use the car park. This constituted a VERBAL CONTRACT ! Although I didn't register on their machine. Which did overide Civil Enforcement s contract to manage the car park as Botanical gardens are the owners !!
I assume this has set a legal precident. Therefore anyone who gains verbal permission from any staff member to park should not have to pay Car Park Charge Notice ( CPN)
THE JUDGE ORDERED CICIL ENFORCEMENT TO PAY COURT COSTS , LEGAL FEES
AND £72.50 TO ME AS EXPENSES
THE CHEQUE ARRIVED YESTERDAY

I haven't received a response from the judge till date. Am bit of losing patience on this now. Its frustrating that I get to loose the reserved costs too because CEL used this loophole of not paying the court fee
Isn't there any other way? The costs were reserved, aren't they enforceable? Also, am thinking of filing a counter-claim on CEL in the small claims court, with reference to this case. Would that be a good thing to do? Any harm possible there, as in, could it backfire?

Just to update on this thread - I finally got the hearing for the payments on 10th Oct. Went there, CEL was absent as usual. There was a different lady judge this time, who told straightaway that this hearing is for costs only and as per my application, the 'unreasonable conduct' cannot be applied against the claimant as the bar for 'unreasonable conduct' is very very high.
So, she drilled down on each and every claim I had done - saying that only loss of earning, travel expenses and Set-Aside fees can be repaid. So, payment is only max £95/- per day, so 2 half-days hearing = £45*2 = £95. I was miffed, as I had to take full day off but she won't listen to that. Further, she was very stingy on parking (counted by the hours) and opened her google maps to see if the mileage I mentioned was exact!. So, overall awarded me £368/- in total and today I got the cheque for it.
Didn't want to argue with her as I was tired after almost 1.5yrs for such a small thing and was glad for it to be getting over. Its a pity court does not takes an opportunity to set a precendent and penalise the likes of CEL heavily. From CEL's point of view, if they are issuing thousands of letters, only few like mine would be getting paltry sum back, it does not makes any dent in their business model. Its an absolute shame.
But, would like to sincerely thank all people (esp @Coupan-Mad) here for their amazing help and guidance, couldn't have done without it.

Hi All,
I just found out a few hours ago, that there is an active CCJ on my name in my Experian report. I checked my experian report a few days back and found a pending CCJ. I got mixed it up with a Notice of Enforcement I had earlier and a cancelled county court judgement for the NOE. After many emails and phone calls to Experian and County Court, found out that the two cases are totally unrelated and the existing CCJ is something which I am completely unaware of.
I got the details finally and found it was related to Civil Enforcement Ltd (CEL). It has happened in Dec 2017 and the CCJ has been issued in October 2018. I definitely could not recall if I made a payment for the parking (14 mins). Also, I do not remember who was driving the car - the registered keeper or the other insured driver.
I had moved to a new address and completely forgot to update my V5C. I did change my V5C address in 2018. All the correspondence from CEL and the Court order has been sent to my old address. I still do not have any images or letter related to the PCN. As a result, I did not get a chance to address the PCN.
I would like to dispute the CCJ in County Court by paying £255/-. But, I have no idea how to start with.
The forum helped me to know what should be done but really have no clue what immediate step should I take next. Also, is there any way I could get the images and the letter related to the PCN.
Kindly advice as I would really need some help.
