Do bits to sell the house or leave it as it is?

Our house is on the market, Not our choice to sell to be honest, this is a messy situation.
But the house needs some work doing to it, Nothing major but needs all new carpets, Stair carpet is missing the bottom step as our puppy ate it, and the others needs replacing as they are old, this was something we were going to do anyway this year, kitchen and bathroom needs to be redone, but its all still working, I think the main thing is the heating we still have the old Warm air Heating system. I have painted all the bedrooms, so they are plain magnolia now.
The house is a three bedrooom semi, its up for £250k.
due to MIL needing money and we have to sell our house for that to happen, I don't really want to spend anything on this house.
I am not on the mortgage or anything to do with this house, and his family have made it clear that it has nothing to do with me, and haven't consulted me on anything, I have lived here with my partner for 8 years and have been paying the mortgage for that time.

Then surely you do have a claim?due to MIL needing money and we have to sell our house for that to happen, I don't really want to spend anything on this house

Well I though I would have been entitled to something too, Seeing as I have been paying the mortgage as well, But his family are sneaky and making sure that I am not involved in anything, apart from clearing the house and the viewings! Even my parnter is keeping things from me too.
Basically his parents have or are running out of savings - Older brother is going to buy the parents house for less than the market value, they have the cash and live there rent free until the pass - Their house is then the older brothers and hes £££ in - Other two brothers dont get much out of it.
But the said brother is still named on our mortgage, and we are unable to take him off, or pay the remainder of the mortgage off - So we have to sell - Didn't consult my partner or myself, they just came round, told us what the plan was and said get the house on the market.
Its a messy situation, which will now see me and two children without a house!0 -
Even if you weren't married you still have some sort of claim on the house. See a lawyer pdq.0

I think you need the relationships board more than this one to be honest.
If I were you I'd move out (without your so called 'partner') to a place of your own and then speak to a solicitor about claiming your share of the equity when the house sells.
Make sure you take all your paperwork with you to prove your contributions!0 -
If what you have said about paying the mortgage is correctly documented, then you have rights; this isn't 1978!
As for the house itself, there will be nothing to gain beyond 'magnolia-ising' as you have done and keeping it as clean as you can. Having an attractive garden or some containerised plants aboutcan work well too at this time of year.
People who will consider it will want their own choice of decor and kitchen etc. Just make sure it is priced to allow for some refurb and base this on comparable sold prices not what people ask or the EA's 'hopeful' estimate..
That's if you decide to sell, of course. If you start to have some say, things may change.0 -

i feel for you OP its a horrible situation to be in. But if i was you i wouldnt be spending a penny on that house from reading your previous thread and the terrible way that family has treated you. It sounds like you were already forced to paint the walls - if the MIL wants the carpets doing then she can do them out of her pocket.

You and your partner may have a liam on the house for a larger share depending in exactly what the declaration of trust says (or if there is no formal declaration of trust, what you have paid)
If your partner has an interest in the property then it is in his, and your, interests for the property to sell for the best price possible.
I'd suggest that you get a couple of agents in yourself and ask them. You can say you are thinking of pmarketing the proeprty (or changing agents) and ask them what differncce to the sale price they think replacing the stair carpet would make, and what difference they thing replacing the heating would make.
If they suggest that it would pay for itself, you and your partner can at that point contact the other owners and propose that the work is done, at joint expense (or at your expense with an agreement that you are reimbursed from the sale proceeds before they are split).
Don't spend anything unless you've got an agreement in place about how you will be reimbursed or how the sale proceeds will be divided.
Meanwhile, if your partner is one of the joint owners then his family can't sell without his consent or a court order, and he is fully entitled to be included in any discussions with the agents.All posts are my personal opinion, not formal advice Always get proper, professional advice (particularly about anything legal!)0 -

As you say, the property cannot be sold (without a court order), unless all the owners agree.
And the OP should certainly be checking out her rights (and those of her children) in this situation.
In her place I would be consulting a solicitor.0 -
Did you get a receipt for the £25k you handed over?
You need to see a solicitor - my thoughts would be see one on your own without your shifty partner - and see what your options are.
For a start if you are named on the deeds then no sale can proceed without your agreement and signature, and what would happen should you now stop paying the mortgage - would the other named parties be chased for payment?0 -
Thanks All - I have been reading threads on here about selling, or things being chucked up reports etc, and worried what will be found on ours.
I have had three agents in, They have all priced it the same, all saying that it shoulndt be on the market too long, as its priced for the 1st time buyers market really. I have done the gardens we have two nice size gardens, the back garden i supose could do with some colour or somthing in there - But again i am doing all the work myself, No one has helped me at all.
Ive never sold a house before, so i dont know what works and what dosnt - At the moment the house is litrally just got the bare min in, as i packed everything else up, My daughters room just has a bed, and a chest of draws in there, thats it. I think i am more worried about the carpets than anyone else, I would prefer just to take them all up and leave them up lol.
Im not ont he deeds or the mortgage - But i have paid in for the last 8years, I have access to the bank accounts, apart from one, which is an old buiness account as we were self employed, but the account was in my parnters name.
The house is owned between three, My partner - his brother and his wife. Stupidly nothing was written down when the £25k was paid to him, again i didnt have any control over that. I was meant to have taken over them on the mortgage after that, but i couldnt and it just stayed the way it is now.0
