Hi Umkomaas. I've not written it up yet and not filed it with the court. I'm looking at the thread which has an example of a defence:

In terms of the legal arguments i can relate to the above thread (i'm not blindly copying and pasting here!).
ES have filed their witness statement/defence with the court and sent me a copy which includes pictures of car being vacated after being parked also when the the car is driven off with passengers getting in.
In terms of facts, the car was not present at the time claimed by ES. It's an hour out on both claims! I have copies of most of the letters abd was guided by BMPA all the way up to this point but which is not shutdown.
I will be writing my defence up shortly and putting what i can in there.
Apologies for lack of informative and detail here. Dont mind talking to someone informally to get up to speed (crash course!) but guess it's not possible.
I'll try and come back as soon as with the defence, get it sorted and file it with the witness statement as ES have done.

All i did was i said i was going to challenge the full claim via the court filing that ES made. The defence is yet o be sent it.

Did you put anything at all in the Defence and Counterclaim box when you said you were 'going to challenge the full claim'?
If so, that will have been taken as your Defence.0 -

If so, that will have been taken as your Defence.
No as BMPA advised dont do anything until they pay the claim fee - ring after a certain and check if they have paid the hearing fee, if yes, then start the work.
