PPI Reclaims not covered by the FOS

doubt you will have any success as its pre-regulation and they are not under FOS jurisdiction.
Also they dont have to provide you with a copy of your agreement from 12 years ago if they dont have it.0 -
Next tell me they were not regulated at the time and only became regulated 2005
Regulation did not start for most many firms until 2005. So, that is almost certainly correct.I have asked them for a copy of my signature but they cannot provide that.
Most insurances havent required a signature for very many years.I then asked them for there underwriters they gave me groupama I sent a questionnaire to them and got a letter back saying they are not responseable
There is nothing wrong with having insurance. The insurer did not sell it to you and therefore has no liability for the sale (unless it is one of their own agents or a small window which is unlikely to apply here).Next are now telling me I have to go though a solicitor.
PPI is not a legal issue. Those taking the legal route have been failing as the courts don't recognise the issues in the same way the FSA does (a lot of this is down to the FSA and not a breach of law).
If it is pre-regulation and the company did not have any prior regulation then it is end of the road.I am an Independent Financial Adviser (IFA). I made a claim with the above for 3 loans with the above , they say there is no issue with the Saale of ppi , however fire to the way they calculate rebates on single ppi's I incurred additional costs when I cancelled or settled the pooches . To cut a longstory short they have offered £243-13 and represents the extra amounts paid anot not the total paid . Totally confused do I accept as I did not knowi could claim anyway or am I due more anyone out there with any advice.0

you need to start your own thread.
they have rejected it, but given you the different between the refund you got and a pro-rata (correct) one.0 -
I’ve done a lot of reclaiming PPI for friends and relatives and been very successful for them. I have three problem companies – advice appreciated.
1. Creation (JJB Storecard) old card – FOS can’t help
2. Freedom FInance – no-one will claim responsibility (IGroup were involved which is now owned by GE Money). Apparently Freedom Finance Ltd was “acting as an outsourced processor on behalf of broker Bespoke Finance Ltd” – based in Gibraltar!!! Freedom still going I believe? Lousy way to do business.
3. Anglian windows (First Plus) – FOS have taken up with Lloyds of London the underwriter.0 -
i had written to egg requesting information on my old credit card account which ran from oct 2000 untill jan/feb 2010.
according to my equifax details i had two account numbers one from 10/2000 to 01/2009 and strange another dated 10/2000 to 09/2006 i dont recall cancelling my account and cant explain this?
in any event my request for info duly came back from egg as having account with card ppi confirming an account number and requesting if i wish to complain to write to a specific address.this was done and acknowlegeded
today they have written back after a 'full review of my account' i purchased the insurance on the 3/10/2000 and they quote
our online sales process :
'does not require you to take out repayment protection insurance as acondition of obtaing the credit card'
'does not provide an advisory service'
'required you to positiviely confirm that you wished to purchase this policy during the online application'
'provided full terms and conditions of the policy and requested you read them before submitting'.
they then advise they cannot uphold my complaint and this is thier final responce on the matter and i may wish to approach the ombudsman etc etc
at present i am considering complaining to the ombudsman but question whether it is even worthwhile.
i dont even remember any of their points stated in their final responce letter when in applied for a credit card l certainly would not ofwanted or more importantly needed a insurance policy had i been completey aware
any comments/feedback

You complain to the broker that sold it to you. The seller is responsible. Not the lender (unless the seller was an agent of the lender)I am an Independent Financial Adviser (IFA). I recently started trying to gather information from several companies i have had dealings with over the years. These included loans and credit cards. I wrote to MBNA to get account details from an old credit card account. This account i remember very clearly had ppi because it was costing me more than the payments on the balance. That's why I cancelled it. I received a letter saying they couldn't compy with my request for information (no explanation as to why). They also stated that they would 'not commence court proceedings' and that my 'debt continued to exist and I was oblidged to continue payment' To make matters worse they cashed the cheque I had sent as payment for the request!!!
I promptly replied that I was at a loss as to why they felt the need to commence court proceedings because the balance on the account is £0. My request for info has no bearing on what I owe and they have accepted payment. I explained I would expect my request fufilled in full within 10 days or I intend forwarding all correspondence to the FOS.
Why are companies allowed to use bullying tactics to scare monger people into dropping claims or potential claims!!!!
Glad now I read these forums because I can see I'm not the only one watch this space0
