    Hi there, the insurer may have been under fos jurisdiction, it may be worth finding out who the insurer was and put a claim in for mis sell to them. Give fos a ring and ask if your insurer was registered then, if they were, then if you put a claim in to the ins, and they say "no", then you will be able to put this into fos.
  • Hi Im trying to reclaim my mis-sold PPi from Direct Auto Finance. Had there final response letter stating there is no evidence and they were not at fault and because they were not regulated by ther FSA so the FOS have no jurisdiction.
    Has any oneany ideas where I can go from here. Thinking of taking them to court but any other suggestions would be of help.

    Hi there, can you find out who the insurer was? as they may have been regulated and you can try to reclaim from them. If they say "no" then you can take this to fos.
  • Recently been told via a ppi Claim Company that the £11,000 ppi Insurance that I had on a load that I paid back within a year in 2003 will not be able to be claimed,as Paragon Finance who sold me the load stated that Compass Finance (now no longer trading) actually sold the ppi insurance. The FOS will not take the claim any further as Compass were not regulated by them in 2003. With the recent Court ruling on PPI and the amount I paid I feel this should be taken further but am at a loss where to turn, please could anyone give me some advice?

    Hi,

    i am new to here and i am starting to claim against lenders for PPI. I do not have the original terms and conditions of the original agreement, but i do have statements. Do still need to write to the lenders asking for the terms and conditions? Or can i proceed with my ppi questionnaire without the terms and conditions?

    any advice and help welcome, many thanks in advance.

    Hi and welcome

    Whoever sold you the account is the ones you pursue and make a reclaim from, so if you had a broker that set up a loan with your lender you complain to the broker and not the actual lender.

    So basically, as long as you have your reasons for being mis sold PPI, and your account number you can therefore continue to make a reclaim.

    Step 3 below takes you to a reclaiming questionnaire, complete and sent to head office or if they have a complaints dept send to them, keep a copy in case you need to refer back to this again at some point, and allow 8 weeks for a decision, good luck.

    Hi and welcome

    Re-contact the FOS, as they have been suggesting the underwriter/insurer direction for ones in the same situation as yourself. I am one of them, but please be aware it may just take some time.
    My broker dissolved, and they were not regulated, and you cannot pursue the lender, but they will check for connections with the underwriter/insurer to the broker, and they would be possibly regulated.

    The FOS have suggest to write to the lender though for the Payment Protection Insurance document booklet, the details of your underwriter/insurer are on these documents, write to them as you would the broker, and if they reject, the FOS will consider taking it on.

    I have an ongoing case, here goes:
    On 31st Jan 2003 I took out a secured loan for £24k with Paragon Finance. I took it out via a broker called Dial4aloan Ltd. When the forms arrived in the post for me to sign, I saw that a box had been ticked for PPI. I definitely did not tick this, I never wanted PPI mainly because it added to the monthly cost of the loan. I sent the signed credit agreement back for the secured loan. Within a few days i telephoned them and said i did not want the PPI. They told me i couldn't cancel it, unless i cancelled the whole loan and re-applied for a new one, which would involve another credit search. As i really urgently needed the loan I just took it.
    The PPI was paid upfront at the start of the loan at £3720.00. I paid my loan back on 13th Sept 2004, and took my loan to another provider which was cheaper (and without enforced PPI). I had a small refund for the PPI of £399.12.
    The basis for my PPI claim is the box was already ticked when i received the credit agreement for the secured loan. i was told i couldn't cancel it. i didn't need it (i already had lifestyle cover with Zurich at that time). And the PPI was only valid for 60 months. Also i had interest accrued on the PPI which was paying back with my loan payments (which i was not told).
    I wrote to paragon on 9th Dec 2008 and they said it was not their responsibility I had to contact Dial4aloan ltd. however Dial4aloan ltd have ceased trading. They were taken over by Welcome Finance. i contacted Welcome Finance on 15th Dec 2008, but they said that they cannot accept my assertations that i was not fully aware of the purchase of PPI and that I ticked the box! (Whereas my agruement is the manner in which the loan was sold to me, not whether I was aware the box was ticked or not!!). They also referred me to the Financial ombudsman. I wrote to the FO and they replied saying that they cannot deal with my complaint because Welcome Finance were not members of the GISC until 27th Feb 2003 (almost 2 months after i took my loan out).
    So now I'm stuck, where do i go from here???

    I just re-read through the small print on the PPI agreement. It is provided by Norwich Union Life & Pensions Ltd, and arranged by Paragon as their agent.

    They were supposed to comply with the Association of British Insurers Claims Code. They list 3 steps in order to make a complaint. 1 is to write to Paragon. 2 is to write to the Chief Exec of general insurance, London & Edinburgh, Norwich. 3 is to write to the Financial ombudsman.

    This i'll be taking step 2 today!!

    London & Edinburgh = Aviva. Your complaint would be that you took out the policy through an intermediary who, it turned out, was not covered by the GISC code and that London & Edinburgh was therefore itself in breach of the code by accepting business from an intermediary who did not subscribe. Had it not done so then you would not be out of pocket.
