No, but I would remove this paragraph, as POPLA do not get it:Therefore, in this case GPEOL should still apply and any putative contract needs to be assessed on its own merits. Consumer law always applies and no contract “falls outside” The Consumer Rights Act 2015; the fundamental question is always whether the terms are fair.PRIVATE 'PCN'? Basically, never talk about 'no loss' or GPEOL.
Thanks CM. I've edited it
Last question before submitting.
Does the scanned PCN need to be attached to the appeal? Or any other correspondence from PE?

If you do want to do that, they should be embedded into your appeal pdf at the point where you are discussing it.
In other words, it is best to only have one pdf attachment.
You do know that your ebay link in your appeal doesn't work, don't you?0 -
Only if you want to use them to enhance your case.

Hi KeithP
Thanks for your guidance. I wasn't sure if it is a mandatory part of the appeal. Your comment cleared it out.
The appeal is a one pdf document, everything 'attached' is within it.
I realised the ebay link isn't working and I have edited it out of the appeal along with the quoted text, I forgot to remove the link and the text referring to it from my post. Thanks for pointing it out.
I will update with the outcome.0 -
Hi
I have just received the e-mail from POPLA that PE do not want to contest the appeal. :T
I would like to thank you all again for your help. This was a really long case (6.736 words long that proved useful). At least this gave them something to do. That proves just one more time that the parking scammers should just stop abusing everyone and the law.
This is a message for other people being abused by these rogue companies: please make everyone's efforts worth it and DO NOT pay their wages, fight back.
I will be following with letters to the MP's and Theresa over the next week to complain about these crooks and hope they'll put a stop to the harassment.
Thanks0 -
Glad to read all of the above!

The best, indeed only way, to get help here is to read the NEWBIES FAQ sticky thread and then if you still have queries then please start a new thread.
Trying to deal with two people's different issues in the one thread can only lead to confusion.0 -
I also read the signage to mean non permit holders can park after this time and didnt realise a fee,Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
