Good afternoon,
I sent ParkingEye an email as advised. Today I received a letter in the post providing the information I requested. It would appear my email served only to remind them of there responsibilities with regards to the PAP.
So this is now 43 days since they acknowledged receipt and 58 days since the day my email response to the LBCCC was sent (and delivered). Way beyond the 30 days required by the PAP. ParkingEye tell me they still intend to go to court if the £80 is not paid within 14 days.
Any thoughts on how a Judge would view their failings here?
Many thanks.0 -
I doubt you owuld get it thrown out on that. PPCs get far too lenient a ride - even missing court deadliens - with very little comeback.
Did they actually give everyting? Is it all for the right car park? Contract included?0 -
No contract. Just a covering letter re-iterating their stance and threatening court. They are insistant that the signage forms the contract. Plus they've now included the evidence pack they submitted to POPLA. Whats interesting is that on the first page of this there is a letter addressed to me and dated April 2018 which says...
"Please find enclosed all information sent to POPLA regarding your recent verification code above".
I did not receive such a letter previously. It appears they're attempting make it appear they sent me the information previously because they are required to do so by the BPA Code of Practice. I told them this in my response to the LBCCC.
