BPA Code of Practice Paragraph 22.16c states “The independent appeal evidence must be sent or made available to the motorist on the same day as the independent appeal service receive it and the evidence pack to the motorist must be the same as the one provided to the IAS. Failure to do this may be considered a Sanctionable Breach of the Code”. I would like to place on record that to date, I have still not received an “evidence pack” from ParkingEye which contravenes the BPA Code of Practice. The evidence supplied to POPLA during the independent appeal process is no longer accessible by myself on the POPLA website as the appeal is closed.0 -
Although PE may have started the legal process, what have you done in relation to contacting the Hospital ( PALS etc) are you aware of the NHS parking principles for staff, patients and visitors?
I haven't contacted the hospital regarding the PCN. I'm also not sure where to find the Bath RUH Parking Principles.

As this letter is to ParkingEye and I'm off on holiday tomorrow I'm short on time so I've added this to the letter to ParkingEye....
NHS patient, visitor and staff car parking principles (last updated 29 October 2015) states that “NHS organisations are responsible for the actions of private contractors who run car parks on their behalf”. As such, should ParkingEye continue to pursue this unjust charge, on receipt of the information I have requested I will be contacting the Director of Estates & Facilities at Bath RUH to make them aware of the failures of ParkingEye to follow the required Protocols, And the practice of ParkingEye to issue punitive, unjustified charges to visitors to the hospital.0 -

IMHO there is no chance whatsoever of them reading it. We find letters are ignored.
Email it instead:

...with the PCN number xxxxxx/xxxxxx in the subject line and 'urgent complaint' and copy in an email address for the CEO or Facilities Manager at Bath RUH.
No 'letters'.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
