Thank you for your help I have now filed my defence via email , do i need to do anything on MCOL? How do they know I do not wish to counter claim as i think that was the question after the defence form. I assume I should not press next on the MCOL defence form now and they will update this tomorrow?
Many thanks , this forum and the people in it are amazing!0 -
Do absolutely nothing on MCOL - nothing at all.
Except of course item 6) on the checklist in post #16.0 -

So I received claimants witness statement and evidence, 50 odd pages with references to: Thornton V Shoe Lane Parking, Vine v Waltham Forest , Parking eye vs Beavis , VCS vs Ctutchley, Chaplair limited vs Kumari, Chaplair vs Kumari . I really hate VCS with a passion , I have since parked there within the 2 hour limit to recieve yet another fine stating I didnt pay for parking, having gone back to the site they have now added a meter and changed the signs slightly, not obvious to people that know the site as a max of 2 hours. Another £100 charge! Any advise appreciated. I will read up on the next steps in the process on the sticky with regards to court but any help/advise much appreciated.0

But surely you already had your WS due date on the court notice that advised you of the hearing date?
Another tip: tear their WS statement apart.
Anything useful come in the response to your Subject Access Request?0 -
Thanks for your reply ! I have checked all corespondance from them and it looks like I never received a reply to SAR I requested via email, they have however included ANPR data , and pictures (old ones from 2010 of the site!! ) etc in the witness statement.
They have brought the court date forward so I am now frantically writing a witness statement bast on examples in sticky post 2 and my defence , the main points are the lack of clear signs but am unsure how to go about working in the whole ANPR argument GDPR etc , is the witness statement & evidence generally what happened on the day as in my defence I state I am the keeper so assume i need to talk as if I have revisited the car park to gather the evidence ?0
