    If you were at a real auction and were outbid the onus would hardly be upon you, as the penultimate bidder to pick up the item. Probably the item would have to be auctioned again.:confused:

    I am not sure if it applied 6 months ago, but the current rules state that you should not list something that you will not be able to deliver within 30 days.

    If you listed tickets 5 ½ months before they were delivered to you, then you broke ebay rules and you cannot really complain if ebay are now disinterested in the situation.

    If you were ticket touting, then frankly a lot of people will be delighted that you got your fingers burnt.

    I think you are misunderstanding the auction process. At no point would the OP have been told he had not won the auction, no one not even ebay can tell who has won the auction until the time it closed. All the OP would have been told is that he was currently not the highest bidder.

    If you have ever been to a real auction then this is the exact process that happens there. Someone will bid and may get outbid, but the auctioneer has on occasions allowed that highest bidder to say no straight away before the hammer falls, for example at the very last auction I attended someone put in a bid, the auctioneer confirmed the bid and also the item just before the gavel fell and highest bidder realised he had bid on one lot too early. The highest bidder was then allowed to withdraw and the hammer fell on the original bidder. Likewise the auctioneer at my auction house is very experienced and has on occasions refused bids from someone as he knows they are not going to pay..real auction houses get time wasters just as ebay do.

    I agree that my local auction house is not exactly Christies, but it is a legit auction house ( as seen on the TV) and withdrawing bids before the hammer falls does occur.

    You are quite right Avoriaz, it is against ebay terms and conditions to sell anything that cannot be delivered within 30 days.

    The tickets were not purchased with the intention to sell them. Basically I got them to attend the concert with my partner but I got a new job & couldnt get the night off.

    It was a local gig so they were purchased only a few months in advance & I attempted to sell them about 6 weeks prior to the gig.

    Regardless of that, the simple matter is EBAY & in particular Paypal couldn't give a toss about their customers particularly the sellers. I could tell you many other stories when I've been stitched up!!
    Nationwide bank charges reclaimed - £1500ish
    Matched betting profit - £94.26 - started 17/11/07
    Quidco - £86.31
    Tesco Clubcard - £520 in deals since August 07
    Competition winnings - £5 Amazon voucher, Family ticket to the Panto worth £57.

    Have you stopped using ebay and, if not, why do you still bother with it if you have had so many bad experiences?

    The majority of ebay trades are smooth and satisfactory for all parties.

    I have over 500 trades with very few problems. The money I have made and saved on sales and purchases far outweighs any problems I have had.

    Ebay and Paypal were quite helpful on the few problems that I had.

    Overall my ebay experience is very positive. Maybe that is because I follow the rules and I check out sellers and buyers carefully. I have 100% feedback.

    There is still no exclusion to the 30 day rule.

    I find it odd that you seem to have had so many problems with ebay and paypal yet as a seller you breached rules that were in place to protect other users. The 30 day rule is to allow buyers enough time to put in a paypal claim for non delivery so it is difficult to argue that this is in any way only for ebay/paypal's benefit. It is by breaching rules that users have problems, if you understand the process then it is almost impossible to be scammed or caught out.

    I would always urge all users whether primarily a buyer or a seller to understand how ebay and paypal works so that they can take all necessary precautions to protect themselves.

    I still have an ebay account but have not used it for a long time. However I dont have a paypal account and wont use them again.

    I agree the majority are but there are still lots that aren't and I dont think that ebay do their best to resolve issues always.

    I have had over 2200 trades, yeah the majority have been successful but Ive had lots of little losses & a couple of big ones. Its funny cos I have never lost out on anything I have bought - I have always received it as described but the problem arises when people allegedly dont receive my goods or pay with stolen credit cards. When people allegedly dont receive their goods & report it to paypal then paypal just deduct the money from my account & refund (allegedly) the buyer. I have also had an instance where I sold some pc accessories for around £190. The buyer paid with a stolen credit card & about 6 weeks later the £190 was taken from my paypal account by paypal even though I had proof of posting (special delivery) and proof of signature - I never got that money back.

    My cousin did have a strange phone conversation with ebay tho once.     I always check out sellers & only buy from people with good feedback & comments, however when you are selling items "buy it now" you cannot check the buyer out until it is too late & saying that just cos a buyer has pos feedback doesnt mean there will not be a problem.

    As a rule I do follow the rules - I must admit i was not aware of that 30 day one.

    I have never had such a situation, but others on here state repeatedly that, if you have used a Paypal approved delivery method, then this should not happen.

    Did you have an acceptable proof of delivery?

    Most people fall foul of Paypal because they ignore the advice from Paypal about which delivery method to use.
