mobile breaks, is replaced, new one does same ...

I had a Toughpad mobile phone for 12m, it died (software problem, not damage). I sent it off, and was just sent another one, nothing re repair/refund, another one just arrived. This new one died after 10m, software again - its in good nick otherwise. Given I bought it as 'tough' and its breaking from internal problems, I'd like some sort of a refund.

Each phone had a 3 year guarantee. I appreciate I've had just under 2 years use, but I now want a phone that works for more than a year! I'm negotiating for a refund, obviously partial - what do people think would be a reasonable amount to settle for? Original had 3 year guarantee, and the replacement has 3 years too - so from one point of view I've had 2 years use from 6 years guarantee. From another, its 2 years use from 3 years guarantee.
But it was a pricey purchase, I just can't work out what would be fair. Purchase price was £1,137 in May 2016, from a legit online retailer who now keeps saying "you've had it 2 years, no refund", actually, I've had it a month less than 2 years - why 2 years?

    No you don't, you have 3 years from the original purchase date, it doesn't get extended each time its replaced,


    if you were getting a partial refund your talking 1/3rd at most of original price, probably better off with a replacement, What does the warranty say you are entitled to? I would suspect it only offers repair or replacement, not a refund
  • Thanks - I hadn't realised the warranty remained at the original 3 year point, are you sure about that?

    I've had some waffly replies from the retailer, they seem to think the second phone has a 3 year warranty.

    But I see where you're coming from - I've had 2 years use from a 3 year warranty - I just don't think a bare 3 years use from an £1100 phone is good value for money.

    I was thinking about it not being fit for use - its actually called 'Toughpad' and it failed twice, not from being not-tough, but from something internal that had nothing to do with me.

    If the retailer is giving 3 years each replacement you are very lucky


    Dunno how much luck you will have with a not fit for use refund claim, Someone else could probably advised there

    If the phone is still under warranty and you have it repaired or replaced, you could then sell it on eBay. Perhaps you would get a price giving you sufficient value when the twenty months' use is included..?
