Actually I would now be tempted to wait until day 56 has passed, then complain to the BPA that a PoPLA code has not been received, and that no NTK was ever received.

I would also send SARs to the DVLA and UKPC based on the SAR thread beginning "June 2018 ..."
Also complain to your MP and Sir Greg Knight MP about this unregulated scam.

I have just received a strange reply from UKPC 45 days after their initial appeal response -

    ....................................

    Do not send to Imail.
    For Appeal report removal only
PLEASE DO NOT IGNORE THIS LETTER. UKPC REGULARLY TAKES MOTORISTS TO COURT WHO IGNORE
THEIR PARKING CHARGES. PLEASE SEE: ukparkingcontrol.com/parking-legalities FOR FURTHER
    INFORMATION.
    Yours faithfully,
    Appeals Department
    UK Parking Control Limited
    ..........................................................

Just looks like another threat to try and get me to pay ? You will need to copy and paste the link into your browser and add "www" to the front of it as I cannot post links yet.

    http://www.ukparkingcontrol.com/parking-legalities

UKPC on the funny stuff again :rotfl::rotfl:

Their site above is so full of flaws and ill conceived
information, it's no wonder people treat UKPC as idiots.

"Amateur lawyers posting on internet forums often advise people to ignore parking charges"

WHOOPS .... amateur parking companies like UKPC, who approve of
fly tipping, been banned by the DVLA twice and tell lies .. huge porkies

And they say ... Do we really take people to court and win?

That is why they are still on the funny stuff ..... we know better

Just another scam outfit approved by the now defunct
BPA NOW RESIDING in the Gobi desert

However threats without a POPLA code is very serious

So its now been 55 days since the UKPC initial response to my appeal and 67 days since the appeal was made . Still no POPLA code, just a couple of threats.

Can someone please direct me to a typical complaint letter to the BPA, DVLA and Sir Greg Knight MP. Sorry total newbie to all this.

No complaint templates. Tell it as it is, ask the BPA to investigate why you have had no decision on your initial appeal and your right to a POPLA appeal is being denied as a result.

Before firing it off, just do a double check on the UKPC website, 'Pay My Parking Charge' (or whatever they call it) as that will give you the current status of the charge. Sometimes it's cancelled, but they have failed to inform you. Long shot, but worth a look before complaining.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

It seems that the skill of letter writing has been lost over the years. It used to be taught in schools

There are a few examples of landowner complaints in the NEWBIES I believe, but there aren't any templates.

You know what the problem is, so write it down. The recipients need to know what you are on about.
You know what you want to happen, so write it down.

Be clear and concise. Be forceful without being rude.

Now it is your time to threaten them, and complain to your MP

This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors.

Parking Eye, CPM, Smart, and another company have already been named and shamed, as has Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each year). They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct

Hospital car parks and residential complex tickets have been especially mentioned.

The problem has become so rampant that MPs have agreed to enact a Bill to regulate these scammers. Watch the video of the Second Reading in the HofC recently.

and complain in the most robust terms to your MP. With a fair wind they will be out of business by Christmas.
You never know how far you can go until you go too far.

    Dear Fruitcake,

You may well be right, but certainly not me. Written hundreds in my time and can write them very quickly with little need to re-phase, when I know what I am talking about. However this is a subject I know little about, so asking for some advice from those who do.

Then I suggest you start a list of bullet points.
List the failings of the process, breaches of legislation etcetera, and a list of the things you want to happen, then expand on each point.

Inadequate signage, breaches the BPA CoP section XXX.
No PoPLA code after 45 days from the initial appeal response. Breaches the BPA CoP section YYY.
Still no PoPLA code. Still breaches BPA CoP section YYY.

They are chasing you for money but are not following the BPA CoP. Access to ADR is yours by right in accordance with the Alternative Dispute Regulations Act 2015, but you are being denied these rights.

No NTK after 56 days so the keeper cannot be held liable.

You want either a PoPLA code or a cancellation.

Well. I am pleased I did not write a letter and opted for some advice first. Thanks to Umkomaas....

Just been on the UKPC website to check on status of my appeal - ITS CANCELLED !!!

    So in summary -

I used the Template to appeal in the Newbie section, asking for a POPLA code. I then received a letter from UKPC asking for the driver details and later a threat to take me to court. I ignored both and now after 67 days since the appeal the fine is cancelled.

Thanks to all those who have given me advice and best of luck to all those that stand up to UKPC !!!!!
