Collision while being overtaken

The other driver made a dangerous manoeuvre.
As you were coming up to a bend on a narrow road, you would not be expected to check for idiots deciding to overtake.
But you would be expected to check mirrors before "swerving" to avoid the pothole. If there wasn't time to check, that suggests the OP was driving too fast.0 -
No, if you read it, I was asking for facts about the process the insurers will use to establish fault and if that has any impact on accepting 'additional' services from my insurer.
No request for opinions at any point.
Well the facts are that you knew someone was behind you and wanting to pass and yet you still managed to not bother looking before steering into their path. Perhaps you should take him up on his offer as you could be liable for 100%.
Of course that's only my opinion.0 -
Last past on p1 - he's already said that's not happening.Senseicads wrote: »you going to upload the dashcam footage then for us all to see? you'd get better idea of fault at least that way.0 -
I am certain I did nothing wrong
I am certain you did.
Mirrors, signal, manoeuvre.
You changed lane (manoeuvre) without the mirrors or signal part. You don't mention the speed limit of the road, or the speed that you were driving. Were you driving slowly, in your opinion?his decision to overtake on a single track road and on a bend won't make any difference?
Overtaking on a bend is certainly bad.
Do you have a link to the area on Google maps?Anyway the point of this thread wasn!!!8217;t to discuss blame
Well, you did say 'I am certain I did nothing wrong'. You did.As you were coming up to a bend on a narrow road, you would not be expected to check for idiots deciding to overtake.
That's reasonable, but it's not what caused the problem. OP swerved into the overtaking car.0 -
If he hit you at your right back side, that's in your blind spot.
No it isn't because it would be in the area covered by the mandatory and legally required drivers side rearview mirror which of course the driver checked before changing direction as they were taught to do when taking lessons for taking their driving test. This is a system account and does not represent a real person. They're not changing lanes, they're avoiding potholes that have appeared around a corner. You only need to make reasonable adjustments. This is a country lane, so driving anything up to 60mph is reasonable. Sure, slower because of the bend and potholes, but it's not considered reasonable to drive so slowly you can mirror signal manoeuvre around a pothole that shows up out the blue.0 -
They said they were going round a corner.
Not consistently. Theyve also said they were "coming up to a corner". Plus utter irrelevant, because there are plenty of minor corners where visibility is clear around the corner and off into the distance.
And your blind spot picture on the motorway. You should (dear lord i hope), be told to check over your shoulder in your driving lessons. Particularly on the motorway (as in your picture, i presume you wouldnt just sweve right to avoid a pothole in that situation) or, say, on a rural road when a driver behind who is clearly keen to overtake is no longer in your rearview?0
