  • Thanks for the responses everyone. So the consensus is that there is no immediate financial risk in accepting the additional services from my insurer, however the cost of these may show on a claim history if this does get recorded as a fault claim and affect future premiums?

    No, if you read it, I was asking for facts about the process the insurers will use to establish fault and if that has any impact on accepting 'additional' services from my insurer.

    The answer to your questions are that they will look at the evidence you both provide and decide liability depending on the strength of that evidence.

    If you accept a hire car it should have no effect on you currently (depending on the terms of your insurance) but may affect future premiums. You will need to check your policy for full details.

    If you wanted facts then you should ask your insurer to tell you what you want to hear, if you didn't want opinions then why post on a public forum!

    In which case, why come onto a forum to get "facts" from a random group of strangers when you could easily just ask them of your insurer? Your insurer is the only party from which you are going to get definitive answers.

    Once again in here a reminder of highway code rule 168 is useful.
    Being overtaken. If a driver is trying to overtake you, maintain a steady course and speed, slowing down if necessary to let the vehicle pass. Never obstruct drivers who wish to pass. Speeding up or driving unpredictably while someone is overtaking you is dangerous. Drop back to maintain a two-second gap if someone overtakes and pulls into the gap in front of you.

    I'd say 50/50. Whatever happens, even if you get 100% on the other it'll stay on your claim history and affect your premium.

    Just to be clear - if your dash footage shows you only made the slightest of movements, then you've got a pretty good case to say he ran straight in to you. If he hit you at your right back side, that's in your blind spot.

    It's still very ropey ground, but the dashcam footage coupled with the damage to the car could very well show that he was overtaking too closely at a dangerous point in the road.

    You can't overtake someone so close that a slight movement will cause a collision. There is a clear guidance of this in the highway code.

    you going to upload the dashcam footage then for us all to see? you'd get better idea of fault at least that way.
