    That's not really what I meant - I meant the section of the relevant LEGISLATION.

    AFAIK the "40%" bit is laid down in legislation, I'm trying to work out where the "2 year" bit is laid down.

    It's because it does not exist! Staff have merely been told by those on Mount Parnassus to implement this time-scale :confused::confused:

    You have quoted the 40% rule a couple of times in this thread so how come they are taking nearly 50% of my GROSS pay? You have asked a couple of time which system am I on. Does it Matter?
    I cannot get any sense out of them and i have written to them to try and get them to lower my payments to 40% of my net income. NOTHING

    The 40% is in respect of your NET income, not gross. When was the last assessment carried out? It may be that their figures are based on an old assessment and so are out of date - but they will still stand legally until you inform them of a change in your income. If you are on CS1 then it is slightly different than if you are on CS2 as on CS2 they can take up to 40% of your net income only, but under CS1 provided that they leave you with your protected income, then the rest is available to be taken.

    Actually, the legislation has changed again, and no specific figure is mentioned now...only "amounts not to exceed a prescribed amount" comment....obvious steps in place to turn the thumbscrews a little more

    i am on cs1 cos they have advised me of an amout that i must be left to live on
    I cannot afford to pay my rent so i have had to leave. That means an extra £260.00 to add to the £90.00 i already had which means i have a grand total of £350.00 per month to live on. Not too bad when you are not paying rent
    i am now living in my car, and relying on a small camping cooker to boil water. I have to use takeaways for most of my hot food. i sleep in my car.
    this situation cannot continue and i have had final warnings from work.
    what a joke and it aint me who is laughing i am homeless but i have been here before

    pd, you are supposed to have your rent left over to live plus some more - the most they could take in respect of CS1 assessments was 30% leaving you with 70% of your income on which to live (not including arrears though). Do you want to PM me with some details and I will see if I can help?
  • I was on the old scheme (cs1) i owe arrears (in dispute)
    I was told to pay £453 a month for x amount of years.
    I'm now remortgaging my home to cover the arrears and mainly to get these incompotent people off my backs.

    Only people that gain from the csa are the csa themselfes!!!! stealth tax i think its called.
