Have you tried to negotiate repayment with them yet? As I said earlier, they may be more sympathetic as there is no ongoing liability to pay. The 40% is the max, but it doesn't mean that they will take that.0

I will negoyiate with them and see what they are prepared to do if anything. looks like it will be better to write to them cos i have read horror stories about ringing them0

the current situation is that the csa have a deo in place and they are taking 50% of my GROSS take home pay. thats right 50% of my GROSS take home pay!!!!!
who do i contact to get this figure reduced.
can i tell my employer to deduct no more than 40% of my net take home pay and send it to the csa.

We are in the same boat as you are pd001.
Although the kids are still in full time education, but my Oh has no problems with paying for them.
The CSA want £81 per week to cover arrears out of a wages, this leaves us with around £143 per week to live on apparantly in black and white in a letter from them and i quote.....
* It's important to know that there's a limit to the amount that your employer can deduct from your earnings. This is how it works: after relevant amount of child maintenance has been taken the amount of money left for you must not be less than £143.62 per week this is your protected earnings.*
Do they know how much it is to live these days??...Rent alone is £80 per week!

Under CS1 which I guess this was, have they stated what your protected income amount should be? They may be applying it to you and then taking anything over and above this amount which is a common thing under CS1 it seems regardless of the 40%.
I know this is only arrears, but what was the last assessment you had? What was the protected income figure on there?0 -
pink, your protected earnings is not the same for everybody, it is based on your protected income if you are on CS1 or it is 60% of net income if you are on CS2.0

How do you know if you are on CS1 or CS2?
Assessment for OH and EX was in 2005, i'm sorry to sound dumb but i didnt use the CSA when i split with my DD's father we had a private agreement, so dont really know much about CSA.

CS2 was introduced for new claims on and after March 20030 -
thanks kelloggs36. So as i understand it, if you are on cs1, and you only owe arrears the csa can take whatever they want using a deo. However ii you are on cs2 and again only owe arrears with no ongoing liability, they can only take 40% of your net take home pay using a deo. Have i understood this correctly?0
