Since it is over 40 years since the original conveyance the OP may have acquired a right of way by virtue of a prescriptive easement.

I see, you recommend trying to upset and intimidate people until they give you something they own and which you have no right to. The Krays did well out of that sort of thing, to be fair.

His first post makes clear he cannot prove it has been in use at all. The original conveyance you refer to contains only standard wording regarding right to light.

If the neighbour parks their big cars in the street, perhaps the OP has on a few occasions left their car on the drive - just a few times - such as after shopping trips and suchlike. Hence car would straddle both owners land and upset neighbour.

That is one thought that had crossed my mind.

But I wouldnt say it was right to try and claim it if so.

Not to mention - OP would have to get written "statements of truth" as they are called from previous owners of their house. In fact "statements of truth" may or may not be truthful actually:cool:. But I'm guessing OP can't get hold of, for instance, whoever owned his house 39 years ago (they'll be long-gone one way or another and might well not wish to get involved if they are still alive).

Even on a "best case analysis" of that - there would be a "neighbour dispute" OP would have to declare and I think it would be pretty clear who had started it (ie OP).

1.25m has never been wide enough for a driveway. It's just over 4 feet. Cars were never that small - old minis were 4ft 8.

    The 1922 Austin 7 was 3ft 10ins wide

And very small for its day. So just over 4 feet has never been wide enough for a drive.

I presume the neighbour doesn't use his garage? It might be worth pointing out to him how he is devaluing his own house by doing this, though.

Devaluing it even further with a neighbour dispute! The neighbour's a Muppet. Neighbour should've discussed this with tea and cake as G_M suggests before doing anything.

I can't see why the neighbour would want to block access to the garage. I can see why the neighbour might want to stop someone from parking on the drive.
