    But you've got the dress now and you said you like be it. Forget the tags for minute and look at the garment itself. Does it have any signs of being worn and do you still think it's good value for money as it is?

    If yes, then you either keep it and leave the appropriate feedback, you try to negotiate a discount, or you send it back as SNAD. .
    I can't see there are any other options open to you.

    He said he must of lost the tags but he knows it cost £130 - in the listing he states it cost £170 - apologies for the confusion.

    It is a beautiful dress, however I do think it has been worn and smells like it has been washed.

    If I had of known it was used I would not of paid so much.

    There are obviously issues with the listing and you are entitled to feel disappointed in that but don't lose sight of owning a beautiful dress that must have been a decent make to cost £130 new.

    If you bought a brand new dress from a shop costing £35 would it be the same quality and look as nice?

    If you think you did overpay then send it back for a refund.

    If it smells like it has been washed and doesn't have the tags, in all likelihood it is a used item that has been sold as new in order for the seller to get more money.

    If you are willing to keep it without returning it for a full refund, the seller may be willing to give you a partial refund, say something in the region of £10 or another figure that is acceptable to you.

    I certainly wouldn't be happy buying an item listed as new and it turned out to be used.

    That's not correct.
    When returning goods for a change of mind return then the extra cost doesn't have to be returned but if something is being returned due to a breach of contract (goods not as described) then the purchaser is entitled to a full refund of all money paid irrespective of the fact that some of this may have been for an enhanced postage method.

    I know that it's a moot point now seeing as the item was sent 2nd class and not Special Delivery but I felt it still worth pointing out.

    Not if they use the ebay option' end auction early and sell to highest bidder'.
