Item Not As Described ... but still want it

Hi All,

After some help:

I was bidding on a dress on ebay which stated in was Brand new with tags, before bidding I messaged the seller asking if I won could he post special delivery as I needed the item ASAP and would pay for this.

The seller was extremely helpful and ended the listing early with me as a winner so I could get the item in time which was really lovely of them.

However on hindsight this now seems odd for a £170 dress for £35.

Anyway the dress came today and it does not have tags on as stated so now this all makes sense.

However I love the dress and do want it, but do feel it isn't as stated.

Any ideas?

    You have the option of a full refund on return if you are unhappy. Legally the seller doesn't have to refund the extra cost of the special delivery you requested, but on eBay they tend to over look this and force seller to return everything.

    You could ask outright for a partial refund if that is what you are angling for, but seller does not have to agree.

    What were you planning to do with the tags?

    If the dress has not been worn and shows no signs of any faults and all you plan to do with it is wear it I don't see the problem.

    That is the issue I am not sure if it is Brand new.

    The tags still being intact would prove this.

    It looks like it is used, but am happy with the item.

    At the end of the day they have not been truthful in their listing - that is the issue

    At the end of the day they have not been truthful in their listing - that is the issue

    It doesn't change your options, you can open a SNAD claim and send it back or contact seller and ask if they made a mistake and see if they will offer a partial refund. Ultimately though you can't insist on a partial refund.

    I think you are being a bit pedantic here.

    You love the dress and you are happy with what you paid for it.

    The seller ended the bidding early so you could get it in time and sent special as you asked.

    Cut them some slack here.

    You have a couple of options send it back for a refund due to SNAD or express your disappointment with the seller.

    If you do message the seller I would start off by saying how grateful you are that they sent it so quickly etc etc then mention that you thought it was BNWT - as others have said they are not obliged to offer a partial refund.

    Ask the seller to send you the tags? ;)
    Should've = Should HAVE (not 'of')
    Would've = Would HAVE (not 'of')

    No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)

    As far as tags go, they don't prove much. There are many sellers out there who retag used items.

    As far as the seller in this case goes, message and say that the item doesn't have tags and shows sign of wear. Don't ask for a refund or to return, just see how they reply and take it from there. They may offer a part discount or something else. It may have been a genuine mistake that they can somehow rectify.

    I am not after a refund in anyway. I just think it is an error.

    They ended early and sent 2nd class as he didn't want to send special delivery
