I agree normally never assume.
However, the CPR state that things are served/filed on a certain date after being posted first class (2nd working day I think). Therefore once something has been posted you are entitled, under the CPR, to assume it's been delivered. Same for email. The law does not expect you to check that every letter or document is received. The same is true of POFA - an NTK is deemed delivered x days after it's posted. The PPC doesn't have to prove it's been received.
If for some reason your document went astray, and default judgment was entered, you'd be able to show without doubt that you filed it and the court would set aside judgment.
The wrong email address being advertised is a worry. But like I said, you complied with the online instructions and can show it's been sent to them.
You would not be expected to phone up and check it's been received. In fact, this would be discouraged: MCOL would have to triple its staffing levels if every time anything was sent to them they had people phoning to check it's been received. That's why they have an online system on which they log what's been received, so people can look it up.
So I understand your desire not to be an !!!, but you wouldn't be expected to phone up to check.Although a practising Solicitor, my posts here are NOT legal advice, but are personal opinion based on limited facts provided anonymously by forum users. I accept no liability for the accuracy of any such posts and users are advised that, if they wish to obtain formal legal advice specific to their case, they must seek instruct and pay a solicitor.0 -
That all make perfect sense. I went on to the MCOL this morning and i got this:
Your defence was received on 02/05/2018
So we are off on the the road to quashing this hopefully.
Again thank you all for all your time and posts, it is all very reassuring0 -
UPDATE
Directions Questionnaires sent in Via sign for post.
I followed this post https://forums.moneysavingexpert.com/discussion/5546325/court-claim-procedure-updated-october-2016
Claimants received
Courts Not received (day 2, Post Office still have it)
Claimant has sent in there DQ to Court on the 19th but not one to me0 -
DQ filed by claimant on 19/05/2018
You filed a DQ on 05/06/2018
Your claim was transferred to LOCAL COURT on 05/06/20180 -
So I now have the court date.
Never received a DQ from CEL.
Just need to send in my witness statement. Not really sure that to do here. Do I just state the same as my defence?0 -
Witness Statements and links to examples should be comprehensively covered in the newbies FAQ, post #2.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Thing is i am sure that the CEL wont even submit there's they haven't submitted and thing else to me.0 -
Just copy the style of another one from a CEL thread that's already been discontinued. The forum really is very easy to search.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
