I purchased an item listed as genuine from a uk seller, i paid a price that reflected that it was genuine - it wasn't just a couple of pounds from a hong kong seller.
I already have a genuine version of this item and there is no way the item i have received is genuine after comparing them. It is also a very poor fit.
I have sent a message to the seller stating that i know it is not genuine, stated the reasons why and asked for a full refund.
I don't know wether or not to expect a reply but if I do get a reply I'm expecting to have to return at my own cost and hope that I am refunded.
I was wondering what Paypal do regarding disputes for fake items. Am I required to return at my own cost? will I be told to destroy the item? Will I need to obtain proof that it is fake?

Yes, you'll need proof.
Technically you're not meant to post a fake item so paypal should not insist you return it. If they do, phone them until you reach someone who knows what the hell they're talking about.

i am not sure how to obtain proof that it is fake. what kind of proof will i need to get?
i am concerned that it may cost me to get someone to check it and declare it a fake.
i will see what the seller says first i suppose, but doubt i will get a full refund without having to send item back. their return policy states no refunds on p&p and have to return at my own cost - although this is for unwanted items.
if seller is not going to cooperate it may be easier to do item not received dispute? since i did not receive the item i paid for and the worthless fake i received was not sent trackable and is fit for the bin.0 -

i am 100% certain it is fake, i just want to know what my options are for getting my money back and what paypal are likely to do and what proof i need etc.0 -
just get a refund with ur postage cost & move on wat u xpect from ebay, better still buy it from the shop next time!!0

a refund including my postage costs is exactly what i want, but not sure if i will get one or not. i am not expecting seller to be cooperative judging by some recent feedback. i am aware that a paypal not as described dispute could go either way and i am not sure how to obtain proof that it is fake.
i expected to receive a genuine item as per title and description. fakes are also available on ebay and they are a lot cheaper and usually from hong kong but i deliberately avoided those.
i would have bought it in a shop if that was possible but as far as i am aware you can't buy them in the shops or even from a reputable online retailer. if you can i've never seen them anywhere around here, and i have looked. that is why i had no choice but to purchase from ebay.0 -
Hi, personally - i think the easiest way to resolve the matter would be to email the seller again.
Just be a bit more stern (but not necessarily rude) and state you are not happy with the item because you know it isn't genuine and you'd like a refund.
Say you will give them 24 hrs to reply, but if you do not hear from them within 24hrs you will have no option but to open a Paypal dispute.
You'll probably hear from them within 24 hours & will more than likely get your money back.0 -

update: i emailed seller 3 times stating i was not willing to send the fake item back in the post and wanted a full refund.
i received 3 automated replies telling me where and how to return the item for a refund. i also received a feedback reminder!
so i started a paypal item not received dispute stating that i had not received the genuine item i paid for. the seller refunded me within hours
i also received an email from paypal with subject "Claim Award Limit Reached" which confuses me as i have only started 3 disputes in the last year, the first one was resolved without paypal, i received no refund for the second one due to seller having no funds and this recent one is the only payout i have received and this was done by the seller themselves.
so does that count as my maximum of 3 claims for the year? even though i only had a payout on 1 of them which was initiated by the seller not paypal. i thought it recently changed to unlimited claims - or did i dream it?
if i have maxed out my claims i will have to start using my boyfriends paypal account to pay for things, via a credit card and scrutinising sellers feedback more closely!0 -
Even though the issue is resolved this time, if it was to happen again, you have the avenue of reporting to Trading Standards if the seller is in the UK.
It seems one thing TS do like getting involved in is fakes of well known items.
if you still have the item and feel the need to punish the seller for selling the fake, you could still take it to TS for action.====0
