Phone the court in the morning and ask them. You are currently asking legal questions of a private parking forum.

Please, far best to get such clarification from the horse's mouth.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

  • I just dont understand the jargon - does it mean I didnt submit the DQ on time or that the claimant didn't ? - I sent it recorded signed for to arrive on time

It just defeats me at times. And I think it's getting worse as each day passes.

You can tell us when you phone, because we cannot know if YOU have been sanctioned (for a late DQ) or if the claimant has been sanctioned for filing a meritless claim with a lack of particulars.

You know what the word 'sanction' means, we all do (it is not a legal term, it's a normal word you can Google in 2 seconds, if unsure) but we can't guess who has been sanctioned!

I worry it might be you. But to find out, you must phone, or wait to receive the letter.

''Signed for'' wasn't a good idea - NEVER recommended by us - and you haven't told us if they even signed on the 'right' day (you have the tracking there, so check it).

The stupidest thing people do is send things to a court signed-for on a Friday. Always makes me despair, bearing in mind such places are not open on Saturdays. Please don't say you did that...(and recorded delivery doesn't guarantee next day service anyway).

You should have emailed the DQ and that would have been immediate.

  • Ok I wasnt aware of that - I sent it on a Saturday and was guaranteed it would be there by noon on the Monday (the day it had to be there) and it cost me £6.50 - Royal Mail guaranteed Special Delivery. IF the sanction is for me there is a suggestion on the that I am granted a second chance ? Is this correct ? Its on MCOL's website - I googled

Thanks in advance - I will contact the Court tomorrow

If you've been sanctioned the court might expect a fee to open the case again. Not good.

What a terrible waste of money for a DQ that you were meant to email.

You still haven't said whether your tracking shows it was delivered in time. That's what you paid for, and that's why you have a tracking number/receipt.

OK I will see what the court says tomorrow - Ill also check the postage (not with me at present) - However it wasnt clear on sticky thread that I could e-mail the link says this

"You send a copy to the courts and another copy to the Claimant company. Keep a copy for yourself. As mentioned before, there is a long delay (20+ weeks) between this form and an actual day in court."

I assumed it meant a physical copy as there isn't reference to e-mailing it - fingers crossed they didn't submit their paperwork in time and not me.

Incidentally the PPC have not responded as yet to my request for SAR that I emailed to them - do they have to reply within a certain timescale ?
