  • is giving a notice for non-attendance according to CPR 27.9 a bad decision and possible loss of case?

    my issue is that I am due to be abroad on the hearing date, and was looking at giving the notice for not attending like the Claimant did.

    In our experience, yes and they might even get this full claim & costs, around £300, which is not right or recoverable but if you are not there to argue it then unless you get lucky with the Judge/and have submitted in detail why you are not liable and further, why their added costs are a pack of lies, you might get clobbered.

    Just an update and a closure on this one! We did go to court and after literally 5 minutes the judge dismissed the whole thing over incorrect permit template the car park management company was using, i.e. no barcode present on passes issued, so we never got to the part or reading our own defence statements.
    I have to admit, they could have argued that point, but because their lawyer being unprepared on the material, it was simply struck out, and who am I to contest that decision! xD
