PCN from UK CarPark Management UK CPM

As I have been doing much reading in the forum I tried to get my problem solved without annoying you all with this thread but I may need handholding....
End of Feb I received a PCN from UK CPM, the parking firm is paid by my company who leases their offices and parking, but unfortunately the pass was only in part visible and they still fined me because they could not read the parking bay allocation. So having done much reading I avoid the loosing appeals and sent them an email, after I received a postal PCN since they are an authorised IPC, with the "one size fits all template" and I get this answer today:

"Good Afternoon,

Thank you for your email.

Our signage has been approved and meets the required code of practice regulated by the IPC.

If you’re denying liability for this Parking Charge Notice, you will be required to transfer liability to the driver of the vehicle at the time of the incident.

We would need you to fill out the slip and send to the address below.

Yes, the charges are based on breaching the terms and conditions of the parking restrictions.

The signs that are installed around the area clearly state ‘ A Valid UK CPM Permit must be clearly displayed in the front windscreen at all times.’ ‘ You must park wholly within a marked bay. No Parking on roadways / yellow line / paved / hatched or landscaped areas’. ‘ If unsure please seek further advice from CPM or refrain from parking’.

Also please find attached photographic evidence of the vehicle on the day of the contravention.

Furthermore, if you would like to dispute your parking charge notice you will need to send an appeal and your evidence to the address below.

Appeals need to be made by the driver or registered keeper at the time of the contravention and should include your full name, address and PCN reference or Vehicle registration number.

Once we have received the appeal, the PCN will be put on hold while the appeals department investigate into the matter.

The Appeals department will respond back within 28 days.

Because I do not feel all answers have been answered do I send them a letter for the formal appeal?

No they aren't. I doubt they are paid anything - PPCs offer their dubious protection racket ''we'll look after your car park, guv'' services 'free' - that's why they fine people/workers, to extract money. Your company is clueless about what goes on really in PPC World, it seems, or they would never have chosen UKCPM to maraud around your cars.

Why did you email them, if email was not offered on the PCN?

Was it a windscreen PCN?

I fired over the email because I thought it would have been a faster and more secure way, even in the newbie guide it says that emails are better but I guess I will print a copy of that email and send it to the address provided.

Is this is any way shape or form possible to win or being an IPC I have no chance?

Yes I did get a windscreen PCN but I awaited for the postal PCN because of UK CarPark Management being an IPC body that is what was suggested in the NEWBIE guide...

Oh yes, 99% are won by posters here (when fully coached) when IPC firms start court claims. There just is no appeal, but submit one anyway as it looks reasonable later, to the Judge at a hearing.

Thank you Coupon-Mad, I have heard back but I don't seem to have a response on whether they are an IPC or BPA member. They state to appeal at the AIS but I know that I am simply wasting my time at this stage, however reading the newbie thread I do not comprehend why I should ignore the debt collector letter? what if I am that 1% that looses? would it be more than the 100£?

Since they are not clear on whether they are a BPA member or IPC, shouldn't I be appealing on the grounds that they have not actually provided full information?

here is what I have received:

"Thank you for your appeal against the above PCN.
We have carefully considered your appeal but on this occasion, I am writing to inform you that your appeal has been unsuccessful as a breach of the terms and conditions of parking occurred. The decision has been made on the basis of:
• A valid permit was not clearly displayed in the vehicle windscreen.
• The photographic evidence of your vehicle supports the above statement.
• Signage clearly states "A VALID UK CPM PERMIT MUST BE CLEARLY DISPLAYED IN THE FRONT WINDSCREEN AT ALL TIMES".
• In order for a vehicle to be parked correctly a valid CPM parking permit must be clearly displayed within the vehicle windscreen at all times. The photographic evidence of your vehicle shows that at the time of the contravention a valid CPM parking permit was not displayed, therefore you had breached parking restrictions within the area and were subsequently issued with a parking charge notice.
• It is the driver's responsibility when leaving their vehicle unattended to observe the area and check parking is permitted. There is clear signage placed throughout the parking areas stating that the land is private property and restrictions apply.
• As you can see from the photographic evidence taken at the time of the contravention, a permit was displayed but it was obstructed by the vehicle windscreen. As a result the operative was unable to determine whether the vehicle was correctly parked / authorised to be parked within the restricted area as the important details located upon the permit face were not clearly visible. The photographic evidence of your vehicle shows that you are within a clear view of one of the many warning signs throughout the development; I have circled in yellow above to alleviate any doubt. All signage states the terms and conditions of parking within the restricted area. Upon reading the signage you have contractually agreed to pay a parking charge fee as restrictions were breached. It is the driver's responsibility to ensure parking is permitted prior to leaving the vehicle unattended within the restricted area.
Please note. Your appeal was submitted outside of the 14-day discounted period, thea:-efo-re you are liable to pay he full fee of £100. You now have 28 days from the date of this letter to make payment.

The Independent Appeals Service provides an Alternative Dispute Resolution scheme for disputes of this type. As you have complied with our internal appeals procedure you may use, and we will engage with, the IAS Standard Appeals Service providing you lodge an appeal to them within 21 days of this rejection.
If payment is not received within 28 days of the date of this letter then additional charges may be incurred, for which you may be liable. The matter maybe referred for litigation in the County Court which could result in a County Court Judgment being made against you. This may impact on your ability to obtain credit in the future. "

Because those letterS (plural, there is a whole chain to laugh at!) are just hot air and has nothing to do with court or anything scary.

NO IAS STAGE. Gawd if you just read other UKCPM threads you'd know all this and you'd know they are in the IPC. You are writing in isolation, sitting on one tiny thread on an iceberg of information you haven't looked at!

They are an IPC AOS member.

Check the list of IPC AOS members to confirm that if you wish.

Post #1 of the NEWBIES FAQ sticky thread tells you to make that check.

Having read most of it now, thanks! if I get summoned to small claims court I shall come back for some more help to put together my defence.

You'll never get summoned to a small claims court.
You may however get invited to defend a case against you, but you decide whether to attend or not - no summons.

You now wait and see if you get a Letter Before Claim or official court correspondence. Post back on this thread if you need help at that time - having read post #2 of the NEWBIES FAQ sticky thread first of course.
