Npc received while on honeymoon - Walsall

Hello,

Basically the npc is on private land(Nando's car park) in Walsall.

Date of photos - 17/12/17 ( I paid the parking as I remember being p****d off that they changed it from being free to park to paid parking passed 6pm with no advisory signage to this happening)
Car is a company car(leasing)

The fine is dated 5/3/18 (stamped on 8/3/18)
I was on my honeymoon from the 9th-28th which means it was sent 19days ago.

I will attach both sides of the fine, can I fight this?

    read and follow the advice in the NEWBIES FAQ sticky thread at the top of this forum

    which company issued the PCN ?

    did it go to the leasing company first ?

    did the PPC write to you or the leasing company ?

    I have read a very similar case at the same location, would this type of argument work(sorry can't post links either but the post name is)

    The fine was issued by a company called CPplus

    It was issued to the leasing company (doesn't have my name on it)

    And posted directly to the leasing company.

    Easy one to win then, following the lease/hire company car appeal template in the NEWBIES thread, specially written by Edna Basher about para 13/14 of the POFA Schedule 4. Go and read it.

    You are the 'lessee/hirer' and you win, by not saying who was driving (and no, the lease/hire firm have NOT told CP Plus who the driver was, only the hirer/lessee). Use Edna Basher's template.

    either way , the info in those threads does not match your case

    as its a leased vehicle, follow the advice in the NEWBIES FAQ sticky thread , especially the EDNA BASHER info and template

    the lease company SHOULD have sent CP PLUS the details and hire agreement etc and CP PLUS should then have written to the hirer

    clearly this has not happened , so appeal as hirer/lessee/keeper of the vehicle

    they have no idea who the driver was, so keep it that way

    Dear Sir,

    Parking Charge Notice [0123456789]: Vehicle Registration [AA11ABC]

    I refer to the above-detailed Parking Charge Notice (!!!8220;PCN!!!8221;) issued to me by Highview Parking Ltd (!!!8220;Highview!!!8221;) as a Notice to Hirer. I confirm that as the hirer of this vehicle, I am its keeper for the purpose of the corresponding definition under Schedule 4 of the Protection of Freedoms Act 2012 (!!!8220;POFA!!!8221;) and I write to formally challenge the validity of this PCN.

    You will no doubt be familiar with the strict requirements of Schedule 4 of POFA to be followed in order for a parking operator to be able to invoke keeper liability for a Parking Charge. There are a number of reasons why Highview!!!8217;s Notice to Hirer did not comply with POFA; in order that you may understand why, I suggest that you carefully study the details of Paragraphs 13 and 14 of Schedule 4 in particular.

    Given that Highview has forfeited its right to keeper liability, please confirm that you shall now cancel this charge. Alternatively, should you choose to reject my challenge, please provide me with details of the Independent Appeals Service (POPLA), their contact details and a unique POPLA appeal reference so that I may escalate the matter to POPLA.

    Thank you for your cooperation and I look forward to receiving your response within the relevant timescales specified under the British Parking Association Ltd Code of Practice.
