    Yes.
    The other guy gave advice then just dropped me on my head, leaving it to someone else to pick up where he left off.
    If you mean me, I am a gal not a guy, and just ran out of time and steam.

    You have no idea what us regular volunteer posters have on our plates at home when we do this in our own time, to help people for free.

  • I'm new here, so I don't know about volunteers who help etc. I understand it must be difficult, I didn't come here to cause bad feeling. I just wanted help. I too have a lot going on in my personal life and the PCN was the last straw..so forgive me if I sounded a bit annoyed, more stressed than anything.
    I didn't want to just use the template letter and put my foot in it as reading it I was unsure about some parts of the letter....

    Example: I am not liable and I believe that your signs fail the test of 'large lettering' and prominence, as established in ParkingEye Ltd v Beavis. Your unremarkable and obscure signs are in small print and the onerous terms are not readable.

    They say they have photographic evidence, I am yet to see this, as my car was NOT there.
    I wonder if anyone else has had the same situation.

    This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors.

    Parking Eye, CPM, Smart, and another company have already been named and shamed, as has Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each year). They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct

    Hospital car parks and residential complex tickets have been especially mentioned.

    The problem has become so rampant that MPs have agreed to enact a Bill to regulate these scammers. Watch the video of the Second Reading in the HofC recently.

    and complain in the most robust terms to your MP. With a fair wind they will be out of business by Christmas.
    You never know how far you can go until you go too far.

    Did you read this in post #1 of the NEWBIES thread:

    A - NO IT ISN'T. YOU DO NOT NEED SPECIFICS. FORGET THE DETAIL, MOST CASES ARE ALL THE SAME.
    Please just send the template appeal as it is. No need for any adjustment.

    Make sure you do not indicate that the appeal is from the driver.
    If 'keeper' is an appeal option, then use it. If 'other' is an option, then that's ok too.

    Ensure you supply the keeper's real name and real address.

    Post back on this thread when if/when your appeal is denied.
