[STRIKE]I've got informed of a[/STRIKE] Your Notice which was sent to the Company Hire - Jaguar - has been passed to me as the lessee/hirer of this vehicle and [STRIKE]I'm requesting from now on[/STRIKE] under the GDPR, you must now deal with me and must remove Jaguar's data from your systems. Jaguar have transferred any potential liability and you can see from the attached document they have sent to me, that they are not the 'keeper' of this car. I am the keeper/hirer/lessee.
I require that any further correspondence is sent only to the above-stated address, as I have [STRIKE] I've[/STRIKE] been given full [STRIKE]authorization[/STRIKE] authorisation to deal with this matter in my own name from now on. [STRIKE]by Jaguar.[/STRIKE] You will find the [STRIKE]authorization[/STRIKE] authorisation document in attachment together with the Notice that was for the first time forwarded to me.
If you use my address to send me more of your usual 'debt collector threatograms' I may not reply to them but you/your agents are not now lawfully entitled to revert to Jaguar at all. If you/your agents do contact Jaguar, I and/or Jaguar will make an immediate formal complaint to the DVLA, BPA and the Information Commissioner about your misuse of data and breach of the GDPR, and you (P4Parking) will be liable for any loss caused to me by your breach.
I expect an acknowledgement within 14 days of receipt of this communication confirming that P4Parking/TNC have updated your data records and have replaced my name and address as the keeper, instead of the owners, Jaguar.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

The day after I sent my details to P4 and TNC, I got an email back from P4Parking saying that the got the message and will be changing their and TNC records to reflect the information. So Jaguar is now out of the way!! :beer:
So on Friday I receive finally at my address another letter from TNC:NOTICE OF INTENTION TO ADVISE CLIENT TO ISSUE SUMMONS
Please be advised that unless settlement of the above parking Charge Notice is received by this office within 7 days of the post mark hereon we intend to advise our above client to investigate immediate legal proceedings against you.
Parking Charges are legally enforceable in the UK.
The PCN issued by our client to you has followed a number of legal principles including;
- It was issued under the guiding principles of contract law as signs at the location offered the "parking contract" and by remaining the motorist accepted their terms. These were breached and subsequently a PCN was isued.
- The charge amount is in line with the findings of the Supreme Court decision in the landmark Parking Eye vs Beavis Case.
- Our client has followed all aspects of the British Parking Association Code of Practise
England & wales - On 4th November 2015 the Supreme Court of the United Kingdom handed down judgement in the favour of a parking operator whom took a motorist to court for non payment of a parking charge [..case online reference link]
Scotland - On 13th January 2017 at Dundee Sheriff Court, George Way handed down judgement of £24500 in favour of a parking operator whom also took a motorist to court for non payment of a parking charge. [..case online reference link]
Should I keep ignoring as advised or complain with P4Parking (TNC client), arguing I've never received the notice at my address in time to appeal?
FYI, even this last TNC letter has a 21st June stamp, and the enevelope (that I'm keeping) has a post mark of 29th June, so the notice period mentioned in the body of the letter may have been already past by the time I opened the letter.

Now that Jaguar are out of the picture, continue to ignore. Only payment of what they are demanding settles this. Just sit back and see what next daft manoeuvre they are threatening - all pretty empty ones!Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

You appear to be getting yourself in a lather over a letter from someone that can't take action (TNC) on behalf of someone that never takes action (P4) for a issue then can never prove (who was driving a hire car.)
It's Scotland so only the driver can be liable. And even when people admit to driving they still don't do court relying instead on people getting themselves in a lather over a letter.This is a system account and does not represent a real person.
