Hey I hope someone can help. Having some trouble with a company that a contract upgrade was done through. I have complained to the company themselves and got nowhere. I tried taking it to the telecommunications ombudsman but they don’t cover third party sellers. They advised me to go to retailer ADR but they don’t work with the company either. Can anyone advice what to do next. The company is E2save. It is a Carphone Warehouse company but they won’t seem to do anything either. At my wits end. Thank you

Your next step would be the court system then. In the meantime, have you tried Resolver?0

I've issued quite a few LBA's to Mobiles.co and always got paid where cashback was involved. It's the only language they usually understand, but is dependent on the strength and proof of your case. It's fairly easy and straightforward and (provided you succeed) won't cost you anything except some time and research. I always addressed my legal documents and any actual claims to CPW (at their registered office) T/A Mobiles.co (or whatever other clone I was claiming against).
Without a good case and proof there will be very little you can do. Good case depends on the law and not on what you think it should be - i.e. whatever you contracted to and the t&c of that contract at the point you agreed to it.0 -

Unfortunately I am not sure that an LBA is possible as it is an upgrade that they allowed my ex partner to take out in my name. They have agreed they should not have allowed that and will cancel it once they access the call recordings to prove they did not speak to me but with all the stalling I don't know what else to do.
It wasn't entirely my ex partners fault as they assured him it could be changed into his name as the previous contract only had one month left.0 -

No one at the moment.
I reported it to O2 at which point they blocked the number while they investigated at which point my ex partner cancelled the direct debit.
O2 came back and said as they did not sell the upgrade there was nothing they could do.0 -

If there's nothing they can do why did they block the number? What exactly did you tell them?0 -
I explained to them that the upgrade had been allowed without my knowledge or consent and that the company that sold it to my ex told him it could be transferred into his name. They advised me to report it to the police.0
