    If you've not received the revised POC as required by the court within the 14 days of the order, then you should write to the court stating that the claimant hasn't complied and ask that the claim is struck (as the court stated in the order).

    Had a look at the costs schedule but in my case there will be just the Further costs for Claimant's unreasonable behaviour, pursuant to Civil Procedure Rule 27.14(2)(g)

    How many hours shall i claim?

    Also i could not find the Sassi..any link for that?

    After my last visit on here i have been unwell and was away from the country and i did not get a chance to write to the Judge and ask for the case to be thrown out.

    Now Upon my return i have received a Notice of Allocation to the small claims Track (Hearing) dated 26/11/2018

    Hearing date is in April 2019

    So where do i stand now? can i still ask the judge to dismiss the case as claimant did not comply with the court order within 14 days initially..it actually took about nearly 3 months to receive this Notice

    Did you read the post immediately before yours? It was posted at 5:11pm last night. I don't expect anything will have changed overnight, and especially when the court date is set for April 2019!

    Immy - you dont lose anything by writing to the judge, as gibven on your hearing letter, now
    You at least have it on record.
  • Ok i shall write to the judge anyway and outline the fact that the claimant did not comply with the court order

    so claiming the expenses part i shall leave till the court hearing date then?
