    Not being the driver is irrelevant in many cases , as the RK you may be deemed to be liable , be it a private PCN or an official one such as an NIP

    Over 8 million private PCN,s are issued annually , none of them are fines or penalties

    If a claimant pays for enforcement , then various issues can happen , they don't always have to be high court bailiffs

    Your conspiracy theories have blinded your eyes, take the blinkers off

    I did not say fines, I am aware that they are not fines but penalty charge notices, only courts can issue fines.
    It may be pedantic but I was rudely told I was incorrect and I wasn't, it isn't a real court
    Only DVLA, the Police and Highways Agency can legally clamp vehicles
    Nobody can force entry into your home to seize goods except for criminal fines, income tax and stamp duty
    Not being the driver IS relevant with regard to a private parking because you would be required to have read the sign in order to be deemed to have entered into the contract
    I was talking about letters from debt collectors that have CCBC forms attached and how debt collectors use these forms to feign legality, not direct correspondence from the CCBC
    I agree this is the wrong thread and I will not post any more. You lot just carry on doing as you are told.

    as I said and you ignored, not Penalties , not fines either , but Parking charge notices as mentioned above

    THE OTHER PART IS INCORRECT because under POFA 2012 which is an 8 year old law (NEARLY) , A KEEPER can be held responsible for the PCN, IRRESPECTIVE OF IF THEY WERE THE DRIVER OR NOT !!

    some of what you say may be true, but filtering out the incorrect parts is what we are doing , until you realise you are on a losing streak and either post 100% correct information or refrain from posting

    A Bailiff (or HCEO for a sum over £600) can. 
    For a private parking charge that's got a default judgment.  It's a CCJ.  It ruins credit rating for six years and can be enforced.

    A bailiff or HCEO can come in and can clamp your car.  Not 'force' their way into your house but they can come in an open door or window.  They can remove your goods and sell them. 

    Yes, all for a private parking charge in a case a Judge has never looked at.

    Now, none of that needs to happen, because since 2017 we've won 99% of defended court claims for PPC scam invoices on this forum including shedloads where the PPC discontinues.

    It is UTTER MADNESS to come to MSE and tell people to ignore PPCs. Even worse, telling people wrongly that they can't get a CCJ nor a bailiff coming round, following a CCBC judgment by default.  Of course they can!  They do!

    (Equally mad if anyone reading this gets spooked and takes from the above that they should pay it.  Read the NEWBIES thread).

    I didn't say you couldn't get a CCJ ( I conceded that i didn't know). I know you can get some kind of debt collector because I had one. Never the less I digress because finally someone has said something sensible (above). Perhaps not for this thread, but I am wondering how can the balliff know that you OWN the car for which you are the registered keeper? I am in that precise situation. I am the registered keeper of the vehicle that got the PCNs but it is not my car (I own a very small portion of it). Upon whom does the burden of proof lie with regard to ownership?

    They can clamp any car in the drive that appears to be yours, or ask neighbours ''which car belongs to number 9?'' or whatever, then clamp it, and stand there until YOU prove it's not yours.  And if you refuse or can't, they remove the car because a neighbour has told them it belongs to your house, or it's on your drive/outside, gives them reason to believe it's yours unless you prove to the contrary.

    If they came knocking then that is not a debt collector, it is an actual bailiff after you - and you've therefore already got a default judgement and your credit rating is ruined for 6 years already...unless you apply to the court to have the CCJ set aside (read set aside threads - it does NOT involve paying the stupid thing).

    This is why you should not have ignored it.  BUT do not panic and pay it - that doesn't remove the CCJ.

    PLEASE read the set aside section of the NEWBIES thread and start your OWN thread - not 'new post'.  NEW THREAD. 

    But ONLY after reading first or it drives us mad and is unfair on our time.
