Wrong spec from Indesit - Curry mis-sold oven

Long story short. We bought an oven from Curry, purchased online, based on the fact that Curry's website stated that the viewing window would be triple glazed.
However after delivery and installation, we discovered that the window is instead double glazed and I rang up Knowhow.
The CS person then rang Indesit and apparently the product had been labelled incorrectly and would be double glazed.
Just want to ask what's our customer's right in this situation, as Curry has offered a full refund, but my dad (who paid for it) wants a replacement with triple glazed door?

    Full refund is acceptable.

    There are a few issues with your dads request, do they make an oven with a triple glazed door which would fit his oven? Is he expecting Curry's to ask Indesit to custom build a door for him? its not going to happen...

    Take the refund and buy one with a triple glazed door if that’s what he wants.

    I guess that would be a valid option. The problem is that he will be away from next week and I am stuck at work most of the time, so it's likely there will be no one at home to sign the delivery...

    That's nobody's issue but yours I'm afraid, if you want a new one with a triple glazed door then you're going to have to arrange for someone to be there when it's delivered.

    What's so bad about a double glazed one anyway, I'm sure thousands and thousands of ovens operate daily with double glazing and no issues.

    Did Currys do the installation too? If you do get a refund, make sure they refund these costs as well.
  • Ok, someone has labelled it wrong, but I do really want to know how does the triple glaze vs double glazed effect it? I'm guessing that the energy rating is not different.

    I am not so sure why my dad insisted on getting a triple glazed one, I was even suggesting him to keep the one we have bought instead!

    I don't see how this is mis-selling, Curry's were simply repeating what they'd been told by Indesit, or are you suggesting that they knew it was wrong but decided not to correct it because of the vast extra profit they were making from triple vs double-glazed?

    Doesn't matter ... even if the detail came direct from Indesit, Currys are responsible for advertising it therefore the liability lies with Currys. There's no way of spinning away from this ... the seller bears the liability because they didn't check facts prior to stating them. Bottom line - the goods are not As Described therefore the OP's Dad is entitled to a remedy ... replacement or refund (which could be partial if Dad and Currys agree that he can keep the oven), and the choice of remedy is with Currys.
